    Default pay for someone running in to u


    if someone runs in to you car so the blame lies on them should u still have to pay your excess?

    what it is ma mates vectra got run in to yesterday and hes with norwick union there askin him to pay his excess up front but hes got a police report sayin hes not at fault. am with direct line and a had the same thing happen to me few years ago and a never got asked for anythin because i wasnt at fault

    anyone clear this up?

    from my experience, its down to the individual companies. Youre mate can pay the excess, but NU should then chase the other company for it and refund him. Others say pay nothing and if it goes 50/50 or your fault, you pay them the excess then.

    I'm with NU and got run into the back of the other week.. Insurance said due to the nature of the accident i wouldnt have to fork out the excess

    Default no fault accident

    I had same situation 2 months ago- white van man ran into me and admitted liability

    You have 2 options

    1) Claim on your own insurance- damage should be repaired within 14 days but you will have to pay the excess, and your no claims discount may be affected Your insurance company should seek to recover the costs from the 3rd party, if it does so it should refund your excess and reinstate your NCD

    2) Claim on the 3rd party's insurance. This took me 6 weeks from accident to repair of vehicle. Not one penny was paid by me, and my NCD is unaffected, although I was lucky in that the other party was insured, cooperated and admitted liability

    If he won't co-operate or wasnt insured it will be easier to pursue option 1.

    Has anyone thought of contacting these no win no fee people when they have been run into the back of and get them to chase it all etc?

    Reason I ask is that I was run into the other week and do not want to claim off my insurance but off his. Rather then me chasing it all thought I might give this way a go.

    Thoughts?

    I believe, but not totally certain, that if you claim off 3rd party insurance, then you are legally bound to supply youre insurance details. This obviously doesnt apply to pedestrians and cyclists.

    i used one of those companies (no win no fee) they got me a hire car next day...claimed for whiplash and got £2000 compensation....and even got 12 courses of physio on my neck.....
