    Default Caught using phone.

    A lad who my son works with has just received a fine through the post for using a mobile phone while driving (not good).As it was in a company van which is a hire van, the hire company also hit him with a £45 + vat admin charge, think he has been given 3 points aswell. There is'nt any photo evidence so does he have any chance of winning an appeal. I did'nt realise you could get a fine through the post for this i thought they had to stop you..

    if it was me i would contest it??? innocent till proven guilty i believe.

    No they can take the reg no and the time. if your boy disputes it they can obtain his phone records to prove it. he is done and its 6 point and £60. What i can understand is that the boys and girls driveing big cars that cost thousands can't be bothered to thave a £100 phone kit fitted. I alaso thing it should be compulsary to have phone kits fitted to all vans and lorries as they are the worst offenders of using phones on the move.

    Would'nt show up on his phone bill, it was company phone.

    He can remember the cop pointing at him so he dropped the phone, happened back in Nov.

    Cop obviously took the reg no and **** action..

    All the new generation Truvelow front facing digital camera have this capability, as do the very latest average speed cams being rolled out.
    No film but there will be a digital video evidence which is sent back to the system and all computer interlinked to the DVLA network.
    Good is'nt it!
    In this instance the officer whilst using the camera saw the lad was on the phone at the time... if the officer saw him on the phone he does not need photo evidence, the word of the officer is good enough in UK law.

    Personally I'm pleased to see irresponsible drivers who use phones while driving being hit with 3 points as well as a fine its long overdue.

    If the lad used his phone which I assume he did then it will probably work out cheaper if he just pays up, afterall if he's guilty why should'nt he.

    The guy in question is not a boy he's 39 (should know better) if it was me i would be asking the company he works for to fit hf kits fitted into there vans cos he was on the phone to the office at the time, they were telling him where his next call was...

    why should he get 3 points? when its fine for the police to break the law while driving and get no fine or points? reasonable punishment should be dealt to all, not just majority?

    Clearly he is a habitual phone user when driving.

    He broke the law, got caught and he should take the punishment.

    from personal experience....

    several forces now have "ghost squads" of unmarked cars and bikes targetting their own officers for motoring offences such as speeding / mobile phoned etc - but they do have a dispensaton to drive without seatbelts in case you need to get out quickly or whilst carrying offenders etc.. - if they get caught by camera vans - they too are procecuted and if they are involved in an accident then they could have the "black box" details pulled and be procecuted in many cases more than a "civilian" they are not above the law - no one is!!

    so..........

    if you see a police officer comitting what you believe to be a criminal offence then there is nothing stopping you from recording it and then popping to the local police station and asking to speak to the duty sergeant or on duty inspector -

    im sure they would be glad to discuss the matter over a cup of tea
