    Default Car crash

    Coming up to 4 months now since my crash, and i'm still driving around looking like a t***, insurance sent me a letter recently saying the other fella is not admitting liability I've not claimed whiplash or anything, so it's a pretty straight forward case. I lost control of my car after having to slam on (it was wet) because of a car undertaking, causing him to crash into the side (as the ABS was in function my car was swaying/skidding). Am I likely to win the case? IMO, he should have kept a safe braking distance, which I thought was always the bottom line!

    Insurance can take up 18months to sort out if someone isnt admitting liability

    Safe braking distance yes, but did you have any witnesses? Otherwise it's your word against his. Hope this gets sorted.

    My mates currently taking his insurance company to court as he had an accident but neither of the parties was claiming responsibility. So after a couple weeks his insurance company decided to say he was at fault to get a quick settlement. 1st he knew of it was when they told himwhich was when he recieved a big bill upon renewal date!

    quite often settled 'knock for knock' as well, you will both loose your ncb and each insurer will pay for their damage.

    I hit a corsa last year which had already hit a mondeo which had already hit a jag...the result apparantly it was my fault that it was foggy the corsa had no lights on and the sun was shining and apparantly I hit the corsa hard enough to impact 3 other cars....thats been going on 13mths and the mondeo owner has taken out a personal claim against me even though I never hit him directly. It takes month to sort out a claim if everyone is blaming each other....me I got home got a second hand front end for my audi bolted it on and drove it for another 8mths before selling it.

    If you lost control and caused him to hit you, then I would say you would be to blame for that and he was to blame for undertaking, knock for knock I would say.

    Sadley dan it looks like a "knock 4 knock",if this is the case you can wait up til 12 months 4 any outcome and then if this is proved ypu both end up losing sadley

    No no, there was a car undertaking me, at a course that would have collided with me, which meant I had to slam on, thus losing control inthe wet. We both had witnesses, I had 2, he 1. His car was wrote off, though a Y reg fiesta. My car just needed a new
    wheel and bumper bolting back on, though looks a mess, still drivable!

    So what do you reckon, think i'll win the case? I mean no one managed to crash into the back of him, i.e. a safe braking distance!
