46 in a 40? oddly enough I always thought you were allowed 10% + 2mph over the speed limit?

My car definately under reads though? it reads about 75 when the sat nav says 70.
Ive always wandered which the police cameras would pick up on though, i imagine they would be picking up nearer the sat nav speed?

Is that a Fixed Penalty Notice or just the s172 Disclosure Notice?
Some people are of the opnion take the endorsement and run, others beleive "innocent until PROVEN guilty"
I accepted my first FPN, then later found out I could have easily taken it to court and defended it (and most likely won)
Ever since then I always suggest declining such a notice and go to court
So much then seems to go wrong, from referring to incorrect signs, road markings, orders, then add to that procedural errors by the crown
It's no wonder they want as much as possible dealt with by FPN!
If it is just a Disclosure Notice, is there anyone at your address with a similar name?
Equally, does the vehicle have two or more named drivers on the insurance policy
If so, ask one of them (not yourself) to take make a request to see the videographic evidence in order to identify the driver
When they come back ask if they can CLEARLY recognise the driver (by face, not by clothes, etc)

The registered keeper is the only person who can respond to the S172 NIP - if you need photographic evidence to determine who was driving, because you have no other means, the registered keeper must do that. Don't forget that failure to comply with the S172 is an offence in itself.
In the case of a private vehicle, the keeper will be expected to know who was driving at the time/place stated - shared company vehicles are legitimately less easy to determine.
Beware - if you get someone else to take the points the police will use whatever methods to check the facts, forward-facing cameras, CCTV, etc and if they find out they'll prosecute for perverting the course of justice - much more serious usually carrying a prison sentence.
