Default Trading in a repaired car..

if you own a car that has been in quite a heavy accident and has been repaired by a aproved repairer through you insurance company are you obliged by law to inform the garage if you were to trade in for a different vehicle.

They should ask you... I had my first Vec-C Estate rear ended and it cost 6K to put right! the garage asked me at trade in, if it had been in an accident and i siad yes, but they had made good the crap job the insurance company repair shop did to it. It didn't affect there trade in price to me on that basis, too much.

Only if its been recorded as a cat d etc. If you know and they can prove you knew from the dates etc I think they could get a bit weird! although not 100% on this.
Now I need a turbo to keep up!

depends on the garage ad the questions that they ask - on trading the car in some reputable garages will get you to sign a disclaimer detailling if you have had the speedo changed, major repairs, engine replaced etc - if you knowingly sign to say no and you have had some of the above done and it comes out then your comitting fraud - and obtaining a percunary advantage as the garage would be giving you more money than the real tangible value of your car - if asked -be honest - may save you some problems in the long run

    Absolutely; disclose only if asked.

Equally when BUYING always ask and get it in writing.

If your car has been in an accident and is not a write off and has been repaired by an insurance approved body shop then it is in the eyes of the law as a perfectly road worthy car. You have no obligation to say if it's been in an accident if you do not wish to do so. That's like saying "Man I once drove for 57miles with a blown headlight bulb but is replaced" or admitting it's had a windscreen replaced on insurance. It's irrelevant. If it's been written off etc that's a different matter.

Car has not been written off, just repaired. The reason i was asking is that the wife's car was hit quite hard from behind and she does'nt fancy having it back so she's seriously thinking about trading it in. Probably would have been better if it had been written off as she has gap cover on it.

Probably better then if you get it valued after it's repaired.
