if you had an accident at work you should still get paid by your work.
those injury lawyers will only take a claim on if they are going to win 100%.
Sorry guy's wasn't trying to scare anyone or owt, the fact is that all too many companies these days just do whatever they like, they make up some BS reason and they kick you out "legally".
But the other side of the coin is, what if they decide they don't want someone who has an injury anyway? then if you didn't claim you'd be left with nothing at all.
You have to make a judgement based on what you know about the company.
well little update today, spoken to work and apparently my boss is gonna make up the difference between sick pay and my wages if i sign a disclaimer letter, which i have received today, basically they saying its all my fault and want me to sign away any rights to a claim
but
on the letter they want me to sign.........they`ve stated that accident happened on the 30th of october, when it happened on the 23rd of october,so do i just sign the letter to get my pay cos in my eye`s the letter isn`t worth the paper its written on because i`m not gonna sue em for anything that happened on the 30th(but then i could always claim for the 23rd)
Seek legal advice mate.
Sounds like ur place is a bit dodgy...
But be warned..
Im currently in the middle of a claim against the Gov and my work place although wont admit are giving me a major hard time at the mo.
Don't sign anything esp not a disclaimer mate.. just tell them to pay u full pay and you'll leave it at that...
yer but the fact they`ve cocked the dates up means the letter`s worthless really so i was wonderin how much fun i could have with it really, might speak to an accident place tommorow
Has the company reported it to the HSE as a reportable RIDDOR ? They have a legal duty to do so due to the time off work as a result of the accident. That will fix the date of the accident. By the sounds of it they don't want to do this ??
i don`t think they do plus the fact it was a broken tool that wasn`t maintained or replaced......tryin to get me to cop the blame instead of a court case
seeing as its the Insurance company that pays out they shouldnt be arsy about it all...
But ofcourse they will be!!
If you make a claim make... be prepared to leave. ... you can claim a few years after the accident too so may pay to wait a bit untill you could easily slip into something else.
also was there any witness?? Make sure they put something in the accident book too and that u get a copy of it... it will make it so much easier to claim if u decide too.
