    Default Need more advice.....

    Handed in my 2 weeks notice at Halfords which meant i finish up on Thursday (the 29th)

    Anyway the deputy manager comes up to me yesterday and says 'your replacement starts monday and we can't afford to pay the both of you so today will be your last day'

    I thought, fine by me - gets me out quicker and i can start my new job Monday, but a few people have said they can't do that and i'm entitled to be paid up to Thursday as i did everything right.

    I've also got 20 days holiday remaining this year which weren't put on my leavers form so i'm guessing i won't be getting those paid either.

    What's your opinion guys?

    The 20 days holiday, are they for the forth coming year, or the year passed? You may not get them if they are for the next 12 months as you need to work a certain amount of time to be entitled to them, or so I understand it. You can only terminate a work period early with mutual consent, so if you said, "fine I'm off" then thats maybe were they'll be able to get you.

    Halfords is a big company point this out to your boss, if he doesnt co-operate its nothing a short sweet phone call to HQ would'nt sort out.

    U wont get all your holiday entitlement it will be worked out what you should get per each month etc..

    But as others have told you.. you should be paid up to the 29th as the 2 weeks notice is part of your contract im guessing

    If you have given the correct notice and been asked to leave early then you must be paid your basic rate up to the end of your notice.

    If you have accrued holidays then you must be paid for them even if you had previously been asked to take them. (But of course you won't get paid for any pro-rata holidays which you haven't accrued yet). Most contracts say that holidays accrue at say 1.5 days/month or something to that effect.

    A word with your manager. Failing agreement, write a letter setting out the facts, copy to head office personnel director.
