Default auto protect and swirl valves

    Hi all

My swirl valves have to be replaced as the bar keeps jumping of.
i thought that this would be no problem and the garage assured me it should be covered under my auto protect policy but now that the car is stripped (at auto protects request) they refuse to pay out claiming wear and tear which is crazy on a non servicable item.
Auto Protect say it has to snap or suddenly fail to be covered.

this leaves me facing a 900 quid repair bill

has any one else ever had the swirl valves replaced under auto protect?

if auto protects policy was to say it had to snap or suddenly fail to be covered then why did they request it be removed ???- leaving you in the "lurch"
and if the garage assured you it would be warranty then - i would be demanding that they (garage and warranty co) put their heads together as to how to resolve the matter at no expense to yourself as of the promises made by the garage and the lack of common sense by the warranty company
at worse case i would look for a 3 way split

surely it did "suddenly" fail when the bar fell off, either its on and working or it's off and broken.

Unfortunately after countless phone calls and arguments Auto Protect have decided that the failure was due to wear and tear and will not be covering any of the cost.

Also Vauxhall customer services will not help as they say it should be covered under the auto protect warranty

The only positive thing is my dealers Eastbourne Vauxhall have agreed to do the work at cost and changed my warranty to a new company and now tell me that they will no longer sell the Auto Protect policies.

speak to trading standards or a solicitor mate, mention that both garage and Vx dont think it wear and tear (expert opinion) and see what they say before you pay for it. as already mentioned unless it has been designed to 'jump off' by Vx which I am sure it wasnt, then it has failed as per the Auto protect policy. use their wording against them, it worked for me with a fire claim.

PS dont forget it is an insurance company after all, there job is to avoid paying out lol.

we tried everything but the warrenty company hide behind a clause that says if a part fails due to wear and tear then its not covered.

and when i asked them how they decide if a part is covered or not the nice man told me it was down to their individual judgement

but my point and my dealers point is that surely every part failes due to wear and tear ?

Have you spoken to a solicitor about it? this sounds like it would be covered under the "Unfair Contract Terms Act" especially as they basing the refusal on non expert opinion. £even at cost it an expensive bill to pay when you bought a warranty that all the experts think should cover it.
