    Default Employment law anyone?

    Been suspended from work this evening. Not too happy about it as i think it's a little harsh. Anyone got any experience, understanding of employment law/rules??

    In a nutshell, been accused of speeding by a Porsche dataloga. Company that leased the car from Porsche want my company to sack me

    firstly sorry to hear of your misfortune mate, hope things get sorted in your favour

    surely theres a proceedure to follow:

    - verbal warning
    - written warning
    - final written warning
    - suspension

    maybe some more details about what it is you do might help, but unfortunatly im no solicitor, only studies law at college and that was mostly crominal law. sorry i cant be of more help, but good luck with everything and dont let it get to ya.

    Im no expert but you have not been given any points on your license because of this, the system they used is there own system which could have lost its calibration, you have caused no damage causing your company to pay out and unless its in your contract that you can not speed in company cars (most would say you are liable for any fines/penalties) they have no grounds for dismissal

    no they carnt do it mate i employ 5 lads and that defo illegal shoul be verbal warnin first then wriiten then thats it mate go 2 citiecense advice mate
    Vectra vxr custome remaps egr deletes dpf and diagnostic work all remaps are custome bench tuning avalible all genuine equipment PM for info

    One further thought - it is imperative that the employer follows the rules about notification of disiplinary procedures etc to the letter otherwise if you go to tribunal at anypoint they get taken to the cleaners.

    Oh and they all changed on 6th April and lots of employers are having a hard time catching up... or so I'm told by my legal advisor.

    Make sure you keep a record of EVERYTHING.

    An employer can be allowed to suspend someone on full pay pending an investigation... In my mind (no expert I'll say it again) this seems a little harsh in the circumstances.

    Agree you should try and get some advice: Union, Citizens Advice or probably best ACAS.

    Deliver and collect cars nationwide from Corsas to Mercs. Been doing it 6 years and have a clean licence. Nothing in my contract about discipline over this type of driving. It's not a police matter as far as i'm aware. My boss has said there in the middle of tendering for the new contract and they don't want to upset the company we move vehicles for, so i'm worried there gonna make an example of me rather than follow the rules. The manager of the other company said to my boss he wanted me sacked

    cant believe how some people fly off the handle, its a little bit of speeding that your accused (not saying your guilty btw) of for christs sakes! it isnt as if you crashed the car after turning up drunk or something like that. I reckon whats happened is that your boss has had an ear full of the boss of the other company and hes taken it out on you. how long have you been suspended for mate?
