    Default Whats are my rights when i buy a scond hand car.

    I was just wondering what my rights are when i buy a second hand car. My veccy is in the garage for repair and ive only had the car for 2 months and they sold me the vehicle with only 1 months warranty. Ive spoken to lots people outside the forum and they all inform me that my statuary rights are that all goods come with compulsory 6 months warranty which is legislation.
    So do i get the dealer to replenish the cost of the repair.
    or have i got a fight on my hands with this rule.

    I work in sales garage mate,

    Although you have been issued 1 months parts and labour warranty.
    Most gulible folk will accept after that months its their responsibility)ie the customer who purchased ie YOU.

    But the dealer IS responsible for the car upto 6 months their after.

    so you may have a fight on your hans and you will/wont win.but if you take the correct chanels you will get a refund or the car fixed.
    I have seen on A NUMBER OF OCCASIONS THAT THE CUSTOMER PAYS HAVE!.

    At the end of the day you have certain legal rights, apart from any 'warranty' expressly given.

    Firstly, try talking to the people you bought it from (was it dealer or independant), what car / age etc? - these would need to be understood too.

    If that fails go to CAB etc.

    What has gone wrong with it?

    If you buy a vehicle from a dealer, you’re covered by the Sale of Goods Act 1979. This means it must be:
    • Of satisfactory quality, bearing in mind its age, what it cost and how it was described to you. It should be free from serious defects, other than those you were made aware of
    • As described. If the dealer says it's a 2-litre, and it's actually a 1.6-litre, you can reject the car and seek a refund or replacement
    • Fit for any reasonable purpose. The car should do all that you reasonably expect of it, including any specifics you state to the dealer. If you need a car for towing and the dealer says a 1-litre supermini will be fine, you can reject the car if it struggles

    i used this on a range rover vouge auto - that ended up having 4 wabco abs pumps in a month...
    the brakes failed and the only warning you had was when you pressed the pedal - a lot of good in a vehicle that weighs in at nearly 3 tonnes....
    i got a refund under the sale of goods act and as i had completed a service and cosmetic repairs following my purchase they even paid me the monies i had also spent

    Inlet manifold went do da on it. Its a Vectra c SRI CDTI 150. The guys a trader. Im starting my first formal channel of sending the guy a letter. Thanks guys so far for the help.

    Check out the Sale of Goods Act 1979, AS AMENDED, others are the Sale and Supply of Goods Act 1994 and the Sale and Supply of Goods to Consumers Regulations 2002. it explains all your rights. If you send any letters state the SOG act and clearly explain what you propose to be done to your car......Always keep a copy of what you have sent and send the letter registered post so you have a signature to confirm it was received. State that you expect a reply within 14 days. I also sent all copies to Pug Head Office....
    I had huge problems with my last car and fought all the way with Peugeot....got the work done at a 3rd of the price as I had major faults within 3 weeks ...if I had known then what I know now I would have rejected the car...too long a story to get into now
    Also check out the Consumer Direct website
    Interesting to know that is Scotland you can have regress against your dealer for up to 5 years even though it would be harder to prove....
    Before writing any letter check out your rights...when writing your letter if you copy and paste quotes from the SOG Act is saves you writing it all out....

    Well consumer direct phoned me on friday and have given me a letter which i need to fill in the blanks. They did say i may of weakened the case by getting the car repaired but i did explain that the car is my only means of transports to and from work.

    Well i was thinking of getting a bus from chelt to hereford. I looked at how much then i looked at what time and how long it would take me.

    So they agreed that my option was the only one. So i will keep you guys posted on what happens next.
