Default How do i stand with this ?

My son was due to take his driving test today in his mums car ( 08 corsa d 1.2sxi). Last night the airbag light came on and would not clear. So when he came to do his test today the examiner asked him what the flashing lights on the dash meant, he told her that the passenger airbag was at fault and could not be reset and that it would be going into the dealers during the week to be sorted. At that point she terminated his test saying that the car was unroadworthy and that it was a health and safety issue, so that was his £62 down the drain. i've since been to the dealer to explain what happened and to book car in to be repaired but I want to know if there will be any chance vx might reimburse him his test fee, car is 1 year old and has 6 month n/q warranty left. I left a message on answerphone today at vx customer services but nobody got back to me as yet. What you all think ??

Health and Safety issue, she havin a laugh !!

So does that mean cars without airbags are unroadworthy...

I'd get the test center to refund you the money or sue the examiner for costs

    Sorry no.

The air bag is listed as SRS or in full The Suplementary Restraint System.
Or to put it another way, in addition to the mandatory seat belt.
If the air bag was not fitted, then the seat belt would be the only, and therefore correct restraint to be used. The air bag warning light is just that, a warning that the bag will not deploy when in a collision. The seat belt and the pretensioners (if fitted) will still operate correctly.

By this logic, will the examiner not use a car if the latest bells and whistles are not fitted ie. Bi-zenon lights for night driving, abs brakes for wet roads, heated front screen for icy mornings and the now obligatory HFC free Air Con to cope with global warning.

    Nanny state over load.

well it wouldn't pass MOT with airbag light on I think so I guess he wouldn't have a leg to stand on in a lawsuit.

we regularly have driving examiners cars appear with a look of panic - for
    • replacement bulbs
    • abs light on
    • airbag light on
    • wipers not working/clearing
the examiner is quite right if the vehicle HAS the component/part fitted it must be in good working order - he/she has every right to refuse to take the test at the time in question if the vehicle is in their opinion "unroadworthy"

i dont think you will get anywhere with vx - sorry to say!

You might be covered on your home insurance or fully comp car, but at £62 it's going to be very near to the policy excess
    Take the loss and rebook

Rather than use your own car, use a driving school as they can normally resource a replacement car ASAP
