    Default ******* insurance compaies

    Had an accident a few weeks ago which damaged my front bumper, and have had all the details of the other insurer and person,spoke to my insurance this morning and they have said my excess is £600 but i did not take out the legal cover when i took my insurance out, so rang up the other persons insurance and said i want to claim on his insurance for the damage, have all his details etc, but they said i have to go through my insurance to sort it out as im the 3rd party.....my veiw is im not the 3rd party as i was the one who was hit...


    anyone got any advice on what i can do?

    you are the third party as you have been hit - you need to go via your insurers - legal cover is only required if it got griefy.....

    you should be able to claim your excess (or your insurers should) from the other party as you were not at fault and not have to fork out a penny !

    As above, go back to your ins company and you shouldn't need any legal cover for them to claim everything off the party that is at fault.

    you do need legal cover,i had a non fault accident and did not hyave legal cover,to get my insurance company to start a claim was very difficult,when you claim you use the legal cover to start and sort the claim,and they sort any other problems.without the legal cover you have to start the claim yourself,in a lot of cases the insurance company will not represent you,you will need a solicitor to start the claim then claim the money back

    As ever - different viewpoints in replies.

    Check your policy document carefully - if you think the company are trying to evade their responsibilities, or you think you've been misled by them, then have a look at the Financial Ombudsman Service. You have to make a formal written complaint to the company first. If you are then still unhappy with response, you can use FOS to try and help. Given the amount ££s you're looking at, a constructive letter and a stamp seem well worth the investment. FOS website gives tips on constructive and effective complaint writing.

    Hope you get the right result.

    Unfortunately, you may find your insurers won't help you as you are TPFT and have no legal protection.

    This means they would expect you to sort the claim yourself. That's the official version.

    My own personal thought is firstly ALWAYS HAVE LEGAL PROTECTION (!) but in this instance try contacting the no win, no fee companies if you can't gey any joy writing to the third party insurers.

    but most insurance companies do not include legal cover as standard,you have to pay extra for it,and those who dont pay for will later regret it when you realise how important it is,also mr orion you are the 3rd party in that you were not at fault but you will need a solicitor to start the claim,then try and claim his fees back at the end of the claim,good luck

    Then you can claim on your own policy and see if your insurers wish to claim off the third party though some have '50/50' agreements whereby they both pay for their customer's own damage and not try to recover their costs because it evens itself out at the end of the year!

    This would mean you your NCB is affected!
