Default Is this a mot failure or not

The other day i noticed the heat shield covering the back box had came off. The nuts holding it up were so rusted they snaped off. Can i just leave it off or must i repair it.

Take it off, it isn't an MOT failure as it isn't a testable item, however if it is that insecure that in the testers opinion it is quite obvious that it is in imminent danger of coming off, then he should advise you on it and even has the option to mark the advisory as 'Dangerous' if he thinks it may cause harm to other road users. So, either take it off or repair it
