Thread: Speed - what fines?

    Default Speed - what fines?

    Got to work today to find that one of the new boys (and yes he has a ford) thinks he was 'flashed' by a police car in a public lay by - on the way down a hill - duel carrage way - - parked up (same way as the moving traffic) with the driver door open and the policeman pointing a hand held laser (?)
    Now he 'thinks' he was doing about 85-90.
    Question is - should he have been pursued to stop him to give him a ticket or will he get a notice in the post - and if he was spotted what fine will get??
    (plus the fine for driving a ford)

    i think its about 3 points and min of £60 fine, but dont hold me to it

    "If you are to be prosecuted, the registered keeper will receive a Notice of Intended Prosecution (NIP) within 14 days. You are obliged to complete the form within 28 days, stating who was driving the vehicle at the time of the alleged offence. If you genuinely do not know who was driving, you must make every effort to find out who was. Neil & Christine Hamilton famously escaped being found guilty as they succesfully claimed that they did not know which of them had been driving. If you fail to return the NIP, you are liable to six points on your licence. Companies and employers are normally expected to keep a record of who is driving their vehicles at any particular time."

    "Fixed Penalty or Summons
    The driver will then get either a Fixed Penalty Notice (Conditional Offer of Fixed penalty) or a Summons. Less serious speeding offences are normally dealt with by way of fixed penalty, more serious by way of summons. If you admit the offence under a fixed penalty notice, you will have to pay £60 and get 3 points on your licence. If you do not admit the offence, it will go to court. Occasionally you may be offered a "speed awareness course" as an alternative. If you receive a speeding summons you must plead either guilty or not guilty. If you plead guilty it may be worth attending court to plead for leniency.     If it was handheld, would normally be pulled over and issues a ticket. However he can be given whats called as a notice of intended prosecution. This has to be issued within 14 days of the offence.

    Assuming that the dual carrigeway is national speed limit. If he was caught, 3 points and 60 pound fine would be the standard. Just wait for two weeks, if he hasnt heard anything by then I wouldnt worry. Oh... and tell him to slow down

    The officer has some choices to make
    If safe enough the officer can make a gesture for the driver to stop

    The alternative is for the officer to record the vehicle details and make enquiries
    The officer can then either :
    visit the address of the registered keeper and serve a verbal NiP if this is also the driver
    or, and if it is a commercial vehicle, serve a disclosure notice on the registered keeper
