    Default What would you do? (Paypal dispute)

    Not going to go into to many details so please don’t ask but I recently bought an item from someone and paid with PayPal. When I received the item it was faulty. The seller claimed the item was fine when it left them and that the fault I described wasn’t a fault and was just how the item was. I tried to claim through Royal Mail who said the Item hadn’t been packaged properly. I have told the supplier that if they are so certain there is no fault then they can refund me my money, I will return the item and then they can resell it. The seller has stated that they will not refund the money till they receive the item and confirm that it is how they sent it out.

    Do I do as they want return the item and risk ending up with no money and no item (although faulty I may be able to get it fixed or sell as spares \ repair to get some of my money back.)

    Or do I let PayPal decide what should happen? At worst I end up with no money but the item. At best I end up with my money.

    I don’t like doing things through PayPal as I would prefer to come to an amicable agreement.

    Iv let paypal settle a couple of disputes like this m8 and they have always found in my favour. The whole point of paypal is that your money is protected against sellers like this, i'd tell the seller that your going to open a paypal dispute unless he is willing to refund for return of the item, fingers crossed you get your money back

    You need to send it back to get a refund, tracked of course but you can raise a claim with paypal. They will tell you to send it back.

    Take a few pics return it with a letter as to why you are refusing the item. Send it signed for, keep copies of all transactions & let paypal sort it. Just be patient as it takes a little time but keep a check on dates to do things or you will miss out. hth .............

    Open up a claim with PayPal, and then say you want a refund. PayPal will sort this out, send it back recorded, provide the information in the case, and you'll get the cash back.

    PayPal is the safest solution but is there any way legaly that the seller will receive the publicity they deserve.

    Was the seller an individual or a business? Did you bid on it or buy it now?

    If it is a business and your did a Buy It Now. Then distance selling regs would apply and you could return it even if it wasn't faulty.

    Go with Paypal complaint and then return it when they ask you too and make sure it's trackable. once they see it's arrived back at the seller they should sort you a refund.

    The item was from an individual not a company. I think i will let Paypal decide. As i said at least that way at worst i can try fix the item.

    esculate the claim with paypal and let them deal with it on your behalf

    Just done that and paypal say they only deliver with non delivery not faulty items.
