    Default Where do I stand?

    I've just found out that a car I own has previously been seriously damaged and not repaired correctly. I was not told this by the previous owner. Where do I stand legally? I presume I can make a claim against him for selling a vehicle that isn't roadworthy? Also I believe that the last mot done on the car just before I bought it, was dodgy. What can I do and what should I do? Thanks.

    minefield m8.......how do you know the bloke that you bought this car off knew it was not road worthy,or put as you say bent mot on it, you can take this car to a vosa testing station and ask them to look it over,but they will only deal with the testing station if its found to be not road worthy......i might be wrong but this might be a cival matter ie a lot of money on your part to take him to court,you could have a word with your local trading standards and see what they have to say........good luck with anything that you decide to do........

    I guess you bought this from a private seller, unfortunately you would be in a better position if you bought it from a trader.

    you need to get dates when the car was crashed,is the car on the insurance register,how long did the the last owner own the car? if you can proove he knew and willingly mislead you on selling the car as now a days you have to say "sold with all known faults",also do you still have the original ad? as this will help,with this info i would go to the citizens advise bureu and see if you have a case,a private seller still has to sell a product with certain conditions and the same if he were a trader,it is just harder to take action

    As it was not declared to me at the time of sale then I believe he intentionally mislead me. The damage is so severe and obvious to experts that it wouldn't have been missed by the previous mot centre. I am going to contact the seller and if he won't pay out willingly I'm thinking the small claims court may be the route to go.

    A seller is under no obligation to start telling you all about the history of the car.

    Did you specifically ask if it had been in accidents/had significant damage repair done? If not then you're stuffed basically. If you asked then yes he has misled you and you will have grounds to pursue in the small claims court.

    But was the damage something that would've required reporting/advising or been worthy of a failure? An MOT tester isn't going to start telling you all about repairs/crash damage on a car if it's got nothing to do with the requirements of the MOT test. It may have been obvious to anyone doing an MOT, but if it wasn't relevant to the test itself then they won't tell you about it.

    It was integral to the car passing an mot as it has failed for this damage today.
