    Default I'm well confused now.

    After being made redundant as in this tread.http://www.vectra-c.com/forum/showthread.php?t=67927
    I have just received the redundancy package and I'm well confused with it all. Why are legal things so confusing
    I'll get somebody in the know to have a look over it before i sign my life away.

    I've lost enough hair working for them. I'm not losing even more trying to work this out.

    I can help with this, having been through it myself 5 months ago.

    Firstly:
    You should get one week's notice for every full year served. This should be on full pay and can either be worked or paid-in-lieu (the company usually decides). If your contract entitles you to a greater level of notice (i.e. 1-month) then this will apply.

    Secondly:
    Assuming you're between 22 and 40 years old, you should get one week's pay for every full year of service. However, this is capped at £330 per week.

    If you're under 22 it's only half of your weekly salary per year served and if you're 41 or over you get 1.5x your weekly salary.

    The reduncancy payment is subject to you having two years of service!

    All that you state above is in the package. I'm quite happy about that.

    One question I'm paid monthly, so i started on 1st Jan and I'm paid on 23rd of each month. They are making me redundant on the 28th Feb. I will get my salary on the 23rd Feb. I think i should get one more months salary paid on the 23rd March is that correct?
    As they have to give me a month's notice. And in effect i'm working a month in advance.

    Yes, you should certainly get paid as usual on 23rd February.

    Whether you get your 23rd March salary depends on when your notice period comes into effect. It seems likely that you should expect it though; plus the redundancy payment.

    Thought you should be given 90 days notice- if not 90 days paid then your package ie if you're laid off after 30 days you should then be paid an extra 60 days as well

    Dismissal Notice

    The minimum legal period of notice for dismissed employees is dependent on the number of years of service.

    • If the employee has been employed for more than a month, but less than two years, they are entitled to at least one weeks notice.
    • If the employee has been employed for two years, they are entitled to at least two weeks notice.
    • If an employee has been employed for more than two years, but less than twelve years, they are entitled to at least one weeks notice for every year of continuous service.
    • If an employee has been employed for twelve or more years, they are entitled to at least twelve weeks notice.

    If the employee’s contract states a different period of notice to the legal minimum, then whichever is the longest applies.

    Sorted it all out in my head now.
    I started on Jan 1st 07 and was paid on Jan 23rd 07. So Ive been given 4 weeks notice and will be redundant as of the 28th Feb 09. So my last salary payment will be on the 23rd Feb 09.
    In effect i was paid 3 weeks late and 1 week early each month.
    I think i put that down right.
    i worked for them for 6 years via an agency before they started me on direct.
    It would have been nice if they put that time into consideration with the month's pay for each year But unfortunately they don't.

    Just need to sort another job now.
