    Default Speeding

    just a quick one guys, my lad is a newish driver [13 months] and has been caught speeding, how many points can you have and still drive?? is it 6 and your banned or can you have six and no more?? i ask this because he also had a minor bump in Sept and has been asked a couple of times to make a statement to which we have not done so and will not intend doing as it looks as though there trying to go for without due care and attention any advise as he seems to be on a real downer and its not helping stress levels in the house hold!! no speed camera's or radar just followed by patrol car and given a fixed penalty notice [endorsable offence].

    You get 6 points and that's it in the first 2 years (licence lost and you need to retake your test) then it goes up to 12 after 2 years.

    I think if you can prove you need your car for your livelyhood etc then they may give you 6 points and a stern warning then that's it but I'm not sure.

    I thought a fixed penalty notice is the end of it? Pay the fine (£30 in first so many weeks then double after it) and then you won't hear anything else from them?

    A Fixed Penalty Notice for speeding (endorsable )is £60. There is no 'discount' for paying early. You have 28 days to pay, otherwise you get sent to court.

    Drivers who have held their licence less than two years have their licence revoked if they accumulate 6 points. (And remember, the points still stay valid for three years). A 'new' driver is highly unlikely to succeed with a 'hardship' defence

    as a night worker starting at midnight it may look like he's going to be st@@@ed then if the due care goes to court as well ??

    Needing to get to work in the middle of the night won't be enough to convince them to let him keep his licence though - as unrealistic as it sounds, they could well argue that he could get a taxi.

    Didnt know an ordinary patrol car could stop you for speeding? calibrated equipment? their word against yours, icould be wrong though (not trying to cause an argument by the way !)

    They can stop you just by measuring the distance between two markers (e.g. two road signs) and timing how fast you cover the distance between them, so it doesn't always have to be radar/laser equipment.
