    Default Advice Please - Resignation

    Hi,

I have got a new job
My current written contractual notice period is 4 weeks
I have told my boss I've got a new job and he is .... disappointed etc...
When I told him that my notice period was effectively 28 days, he said that it should have been 3 months, typo on the contract, all senior people have 3 month etc ..... but my filing cabinet tells me it is 4 weeks.
I work in a specialised area and when I leave my current employer - they will be in a pickle for a while until they replace me.
I am a professional and don't want to let my current or future employer down.

    What should I do?

will your new job wait 3 months
or you could split the differance an see if they would do 6 six weeks
try not to burn any bridges unless you have to.
the way this country is going and jobs going.
it might be usefull to go back a step.
if you know what i mean

If it says 4 weeks on the contract mate **** em , let them sue ya lol . Going nowhere - Don't worry .

Believe it or not , my old boss actually took me to the small claims court for not serving a month's notice . Better prospects can't be put on hold .
He was trying for loss of earnings etc £4g loooooooooooooool , and then the cheeky ba574r0 never turned up at court and it got chucked out anyway

The contract says 4 weeks, so 4 weeks it is.

With your current job, did you ever get a "letter of employment" which also stated the notice period?

Some employers say that the letter of employment is the one they go by and vice versa.

By the way, have you got any holiday entitlement left that you could use to shorten your notice period? ie. still 4 weeks notice but take say two weeks holiday. Then start your new job in three weeks time.

I want to leave ....... I may try and push it our to 5 or maybe 6 weeks

I have lots to do before I leave, so will be putting in lots of hours so that I leave the position in as good a state as I can for the next person.

I didn't really like it when they inidcated that they couldn't let me leave before 3 months

I said clearly that I will not commit to 3 months !

Contract says 4 weeks then thats what you stick too, they have wrote the contract so if they have made an error its not your fault nor down to you to worry about them.

Look at it on the flip side if they said we dont need you anymore i bet they would say you need to stay for 3 months before we can get rid of you.

Thanks Lump ... that comment puts it into perspective.

I work in a specialised field .... I know that my current employer and boss will be in the brown smelly stuff when I leave .... there are certain things that only he and I can do .... and he will have to do them alone until they appoint a successor ... and that makes me feel a little mean.

I guess I may have too much heart ....
