    confused Auto gear box only 2nd & 5th pls help!!!

    Hi all

    My Husband purchased a Signum 2.2 Elegance from Evans Halshaws about 2 months ago! Everything was fine until a month ago!

    The Auto gearbox only manages to select 2 gears - 2nd & 5th, we have taken it to our local Greenhous and had a diagnostic check done on it, and they came to the conclusion that there was water in the gearbox!! We then went ahead and had the gearbox drained at a cost of £235.00, only to find that there is infact no water in the gearbox!!!!

    I am at a loss and extremly fed up, the car is an 05 plate, and we also found out that it had a new gearbox fitted in 2006!! The milage is low so what the hell is happening!!!

    Surely it is not possible for a car to go through 2 gearboxes (soon to be 3, as Greenhous say that it needs another one!!!) in the space of almost 4 years!!

    Evan Halshaws say that thier 3 month Guarentee does not cover this fault!! VX are not interested as it is now out of Warranty!!

    Please help i'm at a complete loss!!

    some one will be along soon to state the correct terms im sure. but if you were sold a car which is not fit for purpose you can sue them and either get your money back or the car fixed your not f****** go bk to where you bought the car from and demand they do something

    I have been in touch with trading standards, and have followed their advice, and contacted the Finance Company!

    But I still can not understand WHY it needs yet another ****** gearbox!!!! am I gonna have to replace the gearbox every 2 years??????

    Evans Halshaw have offered a poxy £500.00 to get the repairs done!!! We have to pay the remaining costs!!

    My advice - do your best to get shut and get a manual , if there's any chance of getting a full or partial refund I say take it .
    I'm currently breaking an 03 elite , granted it's a few year older than yours , but only had 41000 on the clock , the gearbox is fubar and as far as I'm concerned is not economically viable to repair given the value of the car, good luck , hope you get sorted .

    You could push them under the
    sales and goods act.
    and quote

    the product has not lasted a reasonable amount of time...

    This is what trading standards advised me to do when my Gearbox blew up only 3 weeks of owning my Civic.....

    It ended with the Garage and Warranty company splitting the bill between them.

    But yes i would do as someone reccomended here and get shot......... there is obv a problem with this type of box.

    that is shocking, i would tell them straight and if you get nowhere i would go up the legal route

    It needs to be fit for purpose and its clearly not. You get a min of 3 months so take it back and demand that under the sale of good act they repair it. As far as I know its the seals in the auto box oil cooler that fault and put water in the auto box. There is a recall for this that vx should have done. Either way they should do it. Involve trading standards.
    Now I need a turbo to keep up!

    Yep - I would say this falls under the TS goods act my self.... have a read through my thread - some bits may be of help but personally I would fire both barrels at EH.

    Going through the process myself at the moment. Make sure the car is returned (i.e. you cannot use it) and use Supply of Goods (Implied Terms) Act with finance company and Sale of Goods Act against the supplier. Vx and dealer will probably try to mess you about until you give up.
    BE PERSISTENT!!!!!!!!!!
