    Default question for photographers or solicitor

    Just been watching road wars and see how nearly every criminal says to get the camera out their face, (granted their doing wrong and i dont agree for one minute with them) the police always respond with "its a public place they can film where they want and continue to arrest anyone who interferes with the camera, but..... As a photographer you cant photograph someone with out a model release if the images are to be used for gain (much like a tv show) and as a photographer the police also arrest you for causing an obstruction in extreme occasions.

    My question is how do the film company get away with it as i cant see the people in question giving their permision to have the footage used.

    THIS IS NOT INTENDED FOR A "THERE IN THE WRONG SO WHAT" ARGUMENT!

    I may be wrong but the way I see it is. You can take a photo in a public place "ie" standing in the road. The modle release form, I think is more so if you are going to sell/distribute the photos of the model, it waives the copywright laws of her photo. So in effect the pictures of her actualy belong to you.

    I think if you dont want to be fillmed, as long as you ask them in the right manner, then they would stop filming... if you say to them "F*ck off outta my face with that f*cking camera" then you havent achance of them stopping filming. However, if you ask nice and politely then i would think you would have no problems getting them to stop.

    They can film what they like. You always know if they've been found guilty of something because their face isn't blanked out. If it's blurred over they will have been cleared/ not been to court.

    but this contradicts rules for a photographer?

    I cant shoot what i like, all i can imagine is in the end they do give their permission in a way of becoming infamous.

    Mention model release as in effect the film company/tv show are gaining from the footage.

    How does this changes a persons rights once they are convicted (yes i agree name and shame them) but just trying to get my head round this as a few pro togs and they dont have an answer either/

    this is fine if the person cannot be identified in anyway, shoot backs legs etc. i always shoot first then get model release after, ive only ever had one person decline (think they was illegals working in a nightclub ).

    These will be the rules that stop the paperazzi (newspaper photographers) from hounding the rich and famous and wrong doers outside of court from taking and publishing photographs in the newpapers I am sure they don't have permission all of the time.
