No, kick off, drop trading standards in.

Metion that if they didnt mess about with dodgy date then you wouldnt be in this position as you whould have gone else where earlier.

If its on Back order , that means the item hasn't been sent or instock to ship as the supplier is out of stock, so they can cancel the order !!

Likewise I'd speak to trading standards !!

Tell them to take a hike. You've waited a (more than) reasonable time and they've failed to fulfill their part of the contract. Quoting two days and still not having the part after five weeks is taking the pee. You're fully entitled to a refund - just start quoting Trading Standards and Consumer Law and that may prompt them.

Also, how can they use the 'excuse' of "...no refund can be given as the part has been orderd in..." when they haven't actually received the part themselves?!! Surely they can simply just cancel their order as well? Even if they can't it's not your problem.

EDIT: Beaten to it as I was typing!

I'd call them again and simply tell them you want your money back for the reasons stated above, they have failed to deliver in a reasonable time and totally over their quoted lead time.

Don't take no for an answer. If you paid via credit card, I would contact them too and tell them what has happened.

That's different to the local stealer here. If the part is not in stock they order it and you pay nothing until it arrives. If you fail to collect it within I think 14 days of arrival they just put it into their stock.

IMO you are fully entitled to your money back.

get a name of your local trading standards officer, then go into your dealers, when they refuse your refund, tell them you will phone MR (whatever) right now so they can speak to him, they will give you your money back like a shot, most companies know who there TS officer is, soon as you mention there name, they 541t themselves
