Default Paid a deposit on a VX the dealer can't complete, any action I can take?

I did a part exchange deal with the vec against a nearly new Zafira VXR on Wednesday and paid £500 deposit to secure the car and agreed finance etc.

Spoke to them Thursday to find out more details car reg no, delivery date etc but no joy.

Then I get a phone call this morning 3 days after the deal was done - The car has gone missing, they think stolen can't appologise enough.

Bull**** I think it's been sold to more than just me or someone else has offered a higher price.

They have offered me alternative VXR Zafira's, different colour and lower spec but I want what I requested and was offered - Black in colour, with optional sat nav and 19" VXR alloys.

Where do I stand legally? I fear the worst and think I'll just get a refund of my deposit.

It's like being told it's Christmas and then no it's not.

    P***ed Off big time

    Sorry for ranting.

If you have paid a deposit and they have agreed to supply the car then they have to supply a car of that spec. They should offer you a higher spec to keep you sweet not a lower one!.

I would be looking to get some perks from this,so kick up a big fuss....works everytime.

If you are being offered a lower spec then they'd better lower the price.

Gutted for you mate, the tos*ers! I think exactly the same as you, they've had a better offer. Did you actually see the car 'cos if you did i'd be inclined to do a bit of private eyeing so to speak, see if its around the premises somehere. Perhaps not as simple as that eh?

Will have a go the one I wanted was fairly top spec and I've had a llok today can't find one anywhere in the colour I want with sat nav, I know I can change wheels etc myself. So think they're gonna struggle to find one what I'm after, thought I'd landed exactly what I was looking for.

That's the problem after paying and preparing myself for a better spec'd VXR, feel like I'd never be happy in a VXR that's missing 'what I once had' if you know what I mean.

Nah, was being bought in never got to see it, the more I think about it am sure whoever had it had a better offer. Would make it easier to swallow if they just said you've been gazumped sorry mate, nowt we can do about it.
