    Default Stolen Veccy..........advice Please!!!!

    Jus recieved a text of my 'ex' that she has taken my (her) car back!!! In the last few weeks, we've split up, and the car is in her name but my address as i'm about to have a bankruptcy hearing on Thursday, so when I bought it I put it in her name so the bailiffs couldn't take it, it cost me £4000 last Aug 07, and i paid £1000 cash and she extended her loan to another £3000 and i've been paying it back thru my direct Debit into her account every month so I can proove I've made regular payments. I also have the key, and the insurance certificate, so any of the legal-eagles out there WTF do I do? I dont think the police will be much use as it's a domestic???
    Any useful advise will be grateful.

    If she bought it, in her name, and you are paying her back for it, then this is gonna get messy.

    You might have to bite the bullet and let her have it.... either that, or prove to the bailiffs that you had been paying for it, and send them after it.... either way I don't think you will see it again.

    Best advice is to speak to your own solicitor.

    yeah, thats what i'm thinking....
    it's funny, I was only thinking last week while it was in the bodyshop that I should just scribble on the V5 and send it off, and get a immobiliser fitted as i knew she had the spare key!!!!!!
    don't know why I didn't now!!!!!

    Think your on a hiding to nothing here.She can just say she gave you the money every month to pay the direct debt.Also the car in her name and she took out the loan.Cant see you winning this one, but best of luck

    Thought the log book was the reg'd keeper, not neseccerlly the owner? (sorry for the spelling, its late!)

    you are correct .. the logbook is only the REGISTERED keeper, NOT the legal owner..

    BUT as jamie has said.. it's so convoluted and messy, it's only ever going to get sorted in court..

    Oh, BTW.. she can read whatever you post....

    See if you can find it and take your (her) car back again? I guess you've still got a key? Down to her then to prove it's hers (and with the registration document the probability of ownership lies with you).
