    Default Rear Shocks

    Looking for some advice guys.

Bought my car on 13 August from Arnold Shark and got 1 months warranty. Just had the car into my local VX dealer for the handbrake recall and they advised me that the offside rear shock has leaked completely and requires to be replaced ASAP.

Although I'm a couple of weeks over the 1 month period, I called Arnold Shark the guy said that it wouldn't be covered by the warranty anyway and that it wasn't an MOT requirment!!

I know it could have gone at any time but it's likely it was within this last month.

Do they have a duty of care to fix it? Do you think I should try complaining to them? As they serviced the car before I bought it (apparantly!)

    Thanks

I would have thought that the sales of good act would clearly cover this. The car is unroadworthy (as it would definitely fail an MOT inspection), and within 7 weeks of purchase it could be reasonably argued that the fault was there when the car was purchased. Therefore the car is not of 'merchantable quality' and should be repaired at no cost to you.

Seems only reasonable that they do it. I would have argued strongly that they should do it, even if they quibbled. Good practice would also mean that the other side is changed too.
