    Default Need serious help with my car (Arnold Shark)

    They are saying that they have three chances to repair my car, by law. The problem is under the sale of goods act, if i accept the repair i cant get my money back. They have fitted a boost sensor, and it didnt solve it, went to a local arnold clark, and then a dealer, but they have failed to find a fault, but there clearly is one otherwise it woudlnt be in the garage. Therefiore thats three chances to repair it?

    They are saying they want to take it back up to dundee, to try and fix it, but my argument is if an arnold clark and a dealer down here cant fix it, nor will they.

    I really dont know what to do, i have had my car for 6 days of nearly 6 weeks, just want my money back now!

    With that many issues within such a short time frame I would simply be demanding my money back full stop. It would also seem to me for that to be in their favour - ie. they give you your money back then sell it as is at an auction. I am certain that the difference would be less than it would cost to them to have it repaired.

    I am tryking mate but they are refusing point blank to give me my money back, and are saying they will repair it, despite the fact that they have tried once, and tww other garages have found no faults.

    If i accept the repair, then i have no comeback for a refund, and i suspect it wont be repaired.

    Have you called trading standards? whats their point of view on this? If they repair it and don't fix it can you then get your money back? what guarentee are you getting from them that they will fix it?

    No, if i accept a repair, i am not entitled to a refund, this is where the problem lies. :|:|

    i think u need to refuse the car by letter get the CAB in to help u with advise seek a solicitor u may need legal help plus write to VX explain wots wrong with car and wot dealer will / wont do.

    Is it worth contacting VX? What benfit would that have?

    And i cant really afford a solicitor, thats the problem?

    So they are saying they have 3 chances to repair it and as you have already accepted a repair so are not entitled to a refund? What happens when they fail to repair it after the 3rd attempt?

    Well this is what im asking, but im saying they have had three chances, they "repaired it" once, and the fault was still there. It then went to arnold clark preston, no fault found, then to an independant dealer, no fault found, so therefore thats three chances? But they are saying Dundee have three chances?

    But the sale of goods act says i must give them reasonable opportunity to fix it, which i think six weeks and three garages is reasonable?

    Mate, people have suggested some ideas in this thread and other threads on what to do (Trading Standards, HP company, credit card company, CAB etc), go get it done!!

    I feel for yer mate and hope you get it sorted but forget the garage for now and get on to Trading Standards first thing tomorrow. Get yourself some advice.
