    Default Requesting money back? Arnold Flaming Shark!

    further to my other posts regarding my car, its now back with vauxhall, they have had it 26 out of the 30 day warranty, and on two occasions, and are saynig that they cannot find a fault, but are still looking. So there is absolutely no sign of getting my car back, and veen when i do the 30day warranty will have gone. They said it was fixed last time with a replaced turbo sensor yet is still faulty with the same fault.

    I have been offered no courtesy car, just left without my car and five thousand pounds down.

    Anyone know what the score is with asking/demanding my money back?

    Check trading standards mate , my father in law is going through this at the moment , if the car is not suitable for it's purpose ie - getting you from a-b then you are totally within your rights to demand your money back , I take it you have only had the car for this period ?

    P.s - if it's financed , the finance company are jointly responsibe as well as arny shark 50/50 responsibility I believe.

    Well, 2.4K was trade in, 2.6K Credit Card?

    And i have have it for 6 days out of the 30!

    Its fine round town, second it gets on the motorway, it stops playing!

    trading standards , then go get your car and card refunded fella asap.

    The Law

    When you buy goods from a trader, you enter into a legally binding contract governed by the Sale of Goods Act 1979, as amended by the Sale and Supply of Goods Act 1994 and the Sale and Supply of Goods to Consumers Regulations 2002. The law gives buyer and seller rights and responsibilities and applies to the sale of used cars in the same way as to other goods. When you buy from a trader, you have the right to expect the car to be:

    of satisfactory quality;
    fit for its purpose, including any particular purpose made known, and
    as described.

    Make your intentions clear in writing, hand delivered and get them to make a photocopy with date of receipt and their company stamp on too.

    Seems fairly straight forward to me. Obviously they won't like it, but that's how it goes. They have had more than reasonable time to fix the problem.

    law 75 of the consumers credit agreement is that if the goods are faulty or not fit for purpous then u are entitled to a full refund from the credit card company provided to item is over £100.

    u need to get on to this straight away.

    my computer was broke we asked for our money back got onto trading standards and they said if the company is willing to repair it their was nothing i can do it is now back in for its 5th repair i have had to borrow this computer. like you they have owned it longer than me and ive paid for the ****** thing.

    In this case, you have done a very wise thing by paying with your credit card. Get the card company involved.

    Open a dispute now. It's just a call to the CC company and they will send you the forms. I did this to get our tent sorted. Never had to use the them in the end. When I told the shop about the dispute they replaced the tent immediatly.
