    Default Received notice of Intented Prosecution

    What happens now?
    Never had anything like this in 15yrs of driving.

    I got caught at 47mph in a 30 zone.

    This was my fault - some woman walked out from behind a parked car and I had to slam on the brakes was only doin about 20mph. She never even looked up and apologised or nothing! I was so pi55ed off that I stuck my foot to the floor and sped off.

    I know that wasn't clever but she got me .

    And there was the camera van hidden under the bridge in the dark!

    Gutted...what now?

    DONT DISPUTE!!! Its not worth it and you will get taken to court unless you have extremely good evidence proving it wasnt you. save yourself the hassle and pay the fine, take the points, bend over and let the *ahem* lovely policeman continue his work

    if you have never been caught speeding before, ask to go on a course they offer to people that speed and never had history. this will let you off the points till next time

    you dont ask to go on the course

    you get offered it.

    The way it works is this. You first receive the NIP. This then details the offence and asks you to name the driver driving at the time. This notice of intended prosecution has to be postmarked within 14 days of the offence. If this was over 14 days ago you can get off on a technicality

    If its within 14 days, you just have to accept it and send off the form with your name and address. They check your records, and providing you werent driving while banned or whatever, you will either be sent an offer of 3 points and £60, or sometimes if you've got a clean license and the particular camera partnership offers it, a speeders "re-education course". You still have a fine, but no points crucially

    If you just get sent the 3 points and £60 offer, then just accept it. Going to court to fight it is only worth it if you're willing to spend thousands on proper motoring lawyers who can tear the CPS to bits, you are unlikely to be able to do this on your own.

    If it is your first one, depending upon the constabulary, they can offer you a driver improvement course

    Typically 1.5 - 2 days, and about £120-150

    Only benefit, no points, but if you catch another one, you don't get to do the course again!!

    I haven't had a clean licence in nearly 20 years

    Sounds awful, but I don't drive like a tw*t, I drive a lot, and the cameras are always in ****e places

    But, touch wood, if I stay clean until the end of the year, my last three points will be three years old!!

    They stay on for four or five, but they don't count anymore!

    I agree... its highly unlikely the speed awareness course will be offered. Originally it was only offered to drivers caught doing 35 or less in a 30 zone, though I understand it has been offered to some drivers doing upto 40. Always seemed crazy to me, its obvious that drivers at the higher speeds need the speed awareness course more than someone doing 35 or in my youngest sons case recently 33mph... yes thats right he was booked for doing 33mph in Lancashire and was offered the speed awareness course, which he took to save the points.

    In any case, when driving one must always expect some old fool to step from behind cars or whatever, remember one day... that old fool may be a loved one or it may one day well be you. A very good thing for both of you that were you were only doing 20mph when she stepped foolishly in front of you, had you been doing 35mph she may not have been so lucky.

    No such thing as a perfect driver, we can only try to be. Jeeez I make mistakes all the time but I keep trying, its so easy to not realise your suddenly doing over 30, we even have a couple of 20mph zones around here, and I can see the frustration on the drivers face following me when he is forced to slow down when I drop to the maximum allowed speed limit. I've seen a couple of drivers booked when they have impatiently overtaken me, not realising that van camera's are in the area very frequently. Touch wood.. I've been lucky so far, though.. I suppose when you think about it, its not really about luck... its about choice.

    you wont get offered a course doing 47 in a 30 you are usually allowed 10%+3 to get offered one of these courses so would be 36 in a 30
