    Default Semi-Legal Advice Needed Quickly If Poss!

    My girlfriend is being harrassed and verbally abused to such an extent by her team leader and manager that she walked out of a meeting with them yesterday in tears. She has this morning handed in her notice. The manager has asked her to go in for an informal chat with her but someone will apparently be taking minutes. Doesnt sound very informal to me! My girlfriend has asked that she can bring someone in with her as a witness but they have refused. Does she have a right for a witness to be there?

    Not 100% sure as she has resigned but I am sure she IS allowed to take a "friend" with her. In normal employment law she would be able to, again I'm no expert but I am a police officer in a supervisory role and that is what I would expect to happen! Hope this helps but probably not much!

    If I was her, and if the intolerable situation has gone on for a long time, I would get a union rep to be with her (if she is in a union). If not, get a member of HR to be there, and make sure she gets a copy of any notes (whether formal, or informal) and ensure they are accurate and signed.

    She should ask why she can't have a witness, but I don't think she has any right for one to be present. She doesn't have to attend though...

    If she has a greivance, NOW is the time to make it.

    At the end of the day, workplace harasment shouldn't happen, BUT handing your notice in on a whim probably isn't the best response (just being honest from an outsiders position, not knowing any facts).

    I believe the meeting should be under the auspices of Personnel/Human Resources, and she has a legal right to have someone with her. If she is in a Union, then she has a right to have a Union representative with her. She can also request a copy of details held on Personnel file pursuant to such a meeting, (which is why I assume that minutes are being taken). Had a similar issue some years back. They can do it by the book, so can she.

    has she been there for over a year? If so u need to go for constructive dismissal. Contact ACAS asap www.acas.org.uk Phone now and get advise they are really helpful

    Get to know what you are entitled to so u can go in fully informed about your next step if things go wrong. Employers will walk all over you if they think they can. But contact the people that know which is ACAS to get the correct advise. May be a bit premature about contrustive dismissal but if you do not know about it then they have all the cards

    Im sure she can take someone in with her, if they are taking minutes then its not an 'informal chat'.

    It does sound like they are just being awkward saying she cant have anyone with her, anyway if she is leaving/left surely they have no choice if she wants to have someone accompany her, besides if they have nothing to hide then they shouldn't have any objections should they??
