Thread: Bit of advice please?! (Pub bill problem)

    Question Bit of advice please?! (Pub bill problem)

    Basically last friday went to a pub for food (Brewers Fayre) with my girlfriend, her daughter & friend. We opened a tab on my card ate the food and paid the bill along with a cash tip. After this we then joined some other firends of ours at a big table as a couple were leaving to go travelling for a year. My girlfriend and i left (obviously took the kids lol) but friends stayed on and got talking and walked off forgetting to pay their bill. One of them phones the place the next day to explain and pay the bill but is told there were no walk outs last night so there is nothing to pay. She then calls me to say keep an eye on my card in case they use that to pay their bill, i didnt think this would be possible.

    CHecked statement today and i have my bill & £68.88 for the others stuff added to my card went in and hit the roof at the general manager and he said he thought it was wrong when he did this but ultimatley knew someone would come in and complain so he could get some details of the party who left without paying!

    I would think there are some legal implications here of storing card details on a closed table tab or something what do you lot reckon? Sorry it's long but i'm still fuming now! (He has assured me i will get a refund this evening and a call to confirm)

    P.S. How is everyone, i havent been on much lately!?

    Basically, they've taken money from your account without permission, or as I'd call it, theft.

    Reckon you're due a big apology and a bit of goodwill. Oh, and pay cash in future.

    dont think your card could be used as it was on a different table, demand a refund and a money off voucher! if they refuse the voucher write a letter to head office and complain and you'll more than likely get some for of goodwill from them.

    theft requires the "intent to permanently deprive" - rather than involving the police complain to your credit card company, the threat of withdrawal of card services would make any pub serving food worry...

    Thanks for your replies, i wasn't really thinking of the police as they have more important things to do! I was thinking of data protection act though reusing card details from a closed tab!
    It was my debit card but it might be worth a mention to my bank for advice, im still not impressed although have calmed down a bit

    Hurrah, finally after 3 years, a query within my field of expertise!!

    I deal with secure payment systems for a living................basically, although what they have done is not technically theft, it goes against every part of their agreement with their service provider. If they let someone leave without paying, this is their business loss - they are not allowed to take or attempt to take the funds in retrospect unless the customer has previously provided the card details in advance for that purpose - ie starting a 'tab'. They certainly canot take the money from another cardholder 'just because you happened to be with' the non payers.

    When we get queries like this, the only advice we can give is that they should learn to be more vigilant in making sure customers pay before leaving.

    You have every right to be very peed off and demand not only compensation, but a damn fine free meal as well. The manager saying he knew it was wrong completely confirms this - they haven't a leg to stand on!!! Get stuck in!! (if this fails, notify your bank, tell them that the bar have admitted they took this fraudulently, and they will get you your money back, as well as raising a hefty chargeback fee on said eating establishment!) Good luck!!!

    Get on the phone to head office. I used to work for BF and they were pretty good about sorting things like that out. Which pub btw?
