    Default Insurance - HELP

    On Jan 3rd this year when I had my Vectra I was stopped at a roundabout on the inside lane waiting for a gap - when bang! I got hit up the rear end by a bloke in a red people carrier.
    My daughter photographed his car and my damage - and him and his number plate - he gave me his name, address and insurance company, said sorry and agreed that he hit me up the rear end - plenty of people watched - but as I had all his details I never got any witness details.
    Next I call my insurance - gave them all the details and they said not a problem as I had all his details and times, location etc.... and they booked me in for my car to be fixed. It was just the rear skirts that needed to be replaced.
    It was fixed and I had a car during the time in was in for the repair.
    The VX dealer did a really good job.
    I never really felt right in it again, so I exchanged it for the Signum I have now.
    Today my insurance ring up and say that the other party insurance are refushing to pay up....and my insurance now need to set the solicitors in action and need my agreement.
    What is going on? Any one any ideas - am I about to be stung for the repairs and cost of hire car??

    I'm sure they should have arranged all the payments before any work should have been carried out, including the temp. car.

    Insurance for cars is so complicated. Thats why my dads company stays away from motor insurance! lol

    I assumed that the (my) insurance paid for the work - thats why the VX dealer did it - same with the hire car. But why tell me that they have problems getting their money - do they want me to go over to his house and get it - I thought that this was what I paid insurance for?

    no you should be ok .if you are fully comp with legal assistance included then your insurance will fight your claim .
    you will however have to pay for loss of no claims at the time of your renewal if claim has not been settled by then
    this happened to me a few years back and insurance company told me that thay do not dislose pic evidence untill thay see if other party addmits liability but once pics are produced thay settle claim

    Cheers whisky kid - I have been reading Liverpool Vics (LV) small print about the legal bits, as they do not offer legal insurance. (And I have it via another policy)
    In their (LV) policy it states:
    We will be entitled to:
    have total control to conduct, defend and settle any claim; and
    take proceedings, in your name or in the name of any other person claiming under this insurance, at our own expense and for our own benefit to recover any payment we have made.

    So I think they just want my ok to them starting the legal bits. I shall find out tomorrow (their message was on the ansewer phone.

    Case closed I think - LV want my consent to use legal action (at no cost to me) in my name to pursue the other parties Insurer as they have not paid.
    Now I recoken that insurers not paying each other and then using the legal route to pursue must just bump up everyones insurance costs - back to the poor old driver.

    Goes on all the time I am afraid - even if the Third Party's Insurance company know they will have to pay out for the damage to your car they will hold back until the last minute before paying out - commonly the payment will be made about the same time that they receive official court papers trying to recover the money. Think of it on similar lines as how some of us may wait until we get a red reminder to pay a bill, or leaving it till the last possible day to pay the credit card.
