sent my licence away last week to change my address,got it back today and the fixed penalty(3 points) i got in dec are gone

are you sure they have gone or they just missing off the paper part of license, but still on the database? You dont want to get it wrong with the insurance etc.

don't know m8 as i say just sent away licence to change address and came back with points that only got put on a couple of weeks ago gone

They won't be gone - as in not valid any more. They simply have been lazy and not rewritten them back on again. You still need to declare them, especially for insurance purposes, or you could find yourself in deep doodoo.

They'll still count up towards points totting up for the next three years,and insurers usually ask for the past five years.
