Thread: Licensed revoked by DVLA!! Can they do that?!!

    Default Licensed revoked by DVLA!! Can they do that?!!

    this is what happened to me this week........

    went to my dads in west sussex (chichester) in my other car, the Subaru Impreza which is my other toy. (drank like a fish on the way there)
    on thursday night i was driving on the A27 in chichester at 6pm when a Mercedes police car pulls me over into the layby. I give the officer my ID which is my credit card as i was on holiday and thats all i had. Goes back to his car to do a check and then comes back to the car and asks can i get in the police car as he has something to show me. So i get in and straight away i presume its to do with the car insurance as I have a traders policy which was re-newed on the 22/12/07 and the impreza is not listed yet, although it is in my name on the logbook. He then says thats not the reason why he stopped me. He says according to the computer onboard I do not have a current driving licence....as it was revoked in march 2006! I was in shock as i was not aware of this. The officer did not know the reason why but didnt understand either as on the computer it was not showing any disqualifications. He asked can my wife drive the car if she has a current licence, she has and is on my insurance for any car. Although she was now going on to drive my car, he said i would still have to pay £105 to the recovery truck that was on its way (which he called) although the car was not going to be taken to the pound. I waited for the lorry and paid the driver with my credit card £105 ( which i recieved in the post today)....we carry on but i am fuming...at dvla mind you not the police officer and was very very upset. I also had my mother in the car with my little 9 yr old boy who was crying too.
    I ring dvla next morning who told me it was revoked due a demand by Bedlington court (northumberland) and i would have to get them to send a letter or fax to dvla to re-instate my licence. So i ring bedlington court and this lady informs me that i did not reply to a letter regarding a speeding ticket in 2005 stating who was driving the car. I ask did thaey send out ANY letters, of course she said which i have never recieved I said. well dvla should of sent one too she said, which i also never got. She said the only way to solve this is to re-apply to court to hear the matter again, and could take a few months. Now im ****ed off big style...
    SO
    the facts are i never got any letters which i promise on my little uns life i never got, in which case if i was lying why would i pay £1500 a year in insurance? My job is on the line as it involves driving which means my mortgage is also on the line too. my licence has no endorsments ever since passing in 1993 and have full no claims bonus.
    Today i spoke to my mums neighbour who was a officer for west suusex as a traffic officer for many years and then a desk sergeant before retiring last year. He said he doesnt understand any of it and why i had to pay £105 is beyond him. He said the police if they are going to impound a vehicle then someone would drive it to the yard and only call a truck to accidents or illegal parked cars (no owner present). I have the direct number to ring tomorrow to speak to the current desk sergeant and have to ask why i got charged and ask for a DQ1 (any police members welcome to help!). He believed you can only lose your licence due to bad health, death etc and for speeding offences they would have sent out a warrant for arrest anyway.
    I am seeing a solicitor tomorrow plus citizens advice and will find out the future off my job...
    This is very stressful and and advice is welcome.

    Oh yeah..and to rub salt in...when i started to drive home on sunday 2pm a mile from my dads the front tyre exploded so i pulled over to change it and found the wife had not put in the locking wheel nut in the car (she drives it to work) so i had to call out the RAC who put it on a trailer and drove me back to Newcastle, 360 miles at 56mph.

    What would you do? carry on driving which im not saying i will, but I have not done anything wrong but know it is risky ie insurance etc but would you lose your home over this?

    Are there any resident traffic cops on here that can shed light? I was under the understanding that if you haven't paid the fine then they impound your car until you pay etc, not revoke your licence!! Thats jus wrong and to call out a tow truck before finding out if there is anyone legally allowed to drive the car is also wrong!!!

    Something not right here....

    I can't understand why your licence would be 'revoked' by a speeding offence (unless it was very serious) and also why you were not found and informed. Were these letters sent recorded etc or by simple mail?

    I'd be down the traffic HQ asking questions and why did you pay for truck?? I;d have got the wife to drive off and tell the copper to cancel it (as HE ordered it prematurely)

    Time to bang on tables and get to the bottom of it.

    Not a good situation at all.

    OMG, That's unbelievable mate . I hope it all pans out ok for you. A DQ1 btw is a DVLA printout of your complete driving licence history. If it's to do with your licence, it's on the DQ1. HTH and fingers crossed for you bud .

    had something similar back end of last year when someone bumped into me in a car park scratching my bumper. accident was his fault only took paint off rear bumper so i rang insurance who then collected car and arranged delivery of a hire car for me free of charge.
    hire car company tured up with a brand new mercedes e220 cdi , asked for my licence for their records, showed them my receipt for driving licence as i got pulled speeding on motorway week before (94 mph standard points fine etc) they then rang dvla as receipt didnt have my licence number start and expiry dateon it to wich dvla replied my licence was revoved in 2001.
    after i asked why it was revoked they said they did not know as they only keep records back for 3 years. my reply was that if they only kept records for 3 years surely i should have my licence back now as they do not know what it was for, reply was that i need to re apply for a licence but there would be no charge as it was so long ago.

    i then asked why when i was pulled for speeding the week before and the police did a check on me whilst i was in the back of their car the reply came back verifying my name, address, tax, insurance and full uk licence that they never said it was revoked, this is the pure gem, his answer was " well sir i do not know what database the police use to verify if you have a driving licence" my response was " i think you may find they use the dvla database as you issue driving licences" at this point he said he would send out an application form for a new licence with a covering letter to return with it stating it was free of charge.

    i know exactly what my licence was revoked for, i worked for a delivery company at the time using their own vehicles, a few months after i left i received a letter stating i had been flashed by a speed camera on the road, 3 weeks after i stopped working for the company, someone else was driving and the admin staff had not changed my details to the new driver of the van, i had to go to court and make a sworn declaration that i was not driving the van or working for the company at the time and the points and fine were dropped.

    obviously the courts never passed this information onto dvla and as it wound me up so much i was never going to tell them so i put my black and silver reg plates back on the car got pulled again a few weeks later and whilst in the back of the police car getting my little ticket to take to the mot station to get stamped i asked the kind policeman to check if i had a licence as i still only had my receipt from when i got pulled speeding the previous month.

    his reply over the radio was "full uk driving licence"

    when did the DVLA get the power to revoke your licence

    as far as im aware only the courts can and doctors can i think.
