    Default wife stopped for speeding

    i have sent a pm to MLC to ask his expert opinion on the above, but yesterday my wife was stopped for doing 53 in a 30 and as neither of us have any convictions was wondering what sort of penalty would be imposed.
    she knows she has done wrong and is absolutely bricking it despite me trying to assure her that it is not the end of the world.
    whacha reckon are we looking at points and a fine or even a ban due to the annual festive purge?

    Think positive she can never moan at you again for going to fast !!,
    Would imagine it is points and a fine,....but that is a wee bit over the speed limit.Tell her not to worry it is not as if she has written the car off.

    Gutted for you, but fair play for holding your hands up.

    No expert in this area but, working on the whole 100 is ban at a speed limit of 70 (nearly 40% higher) I would expect the worse, then if you get less, leason learnt.

    I honestly wouldn't expect her to get banned at that, points & a fine IMO, did the officer not issue the penalty there and then?

    I'm sure she will just get a fine and points.

    I don't class myself as a boy racer lol but its so easy to go over the limit with modern cars .I have just fitted the snooper camera detector it tells me the speed of the road I am on and it also tells me if I am speeding even when there are no cameras

    I'm assuming that he didn't offer to deal with it by the roadside i.e. Fixed Penalty and 3 points and that he went straight to reporting her for consideration of prosecution and she'll be getting a summons?, given the amount over she was. When I picked up recent, and first, speeding points it was for 88 in a 70 (dual carriageway), so 18 above (even if it was for only half a mile! lol) She was 23 so maybe it'll be the same.

    I suppose it depends on how much of a crack down they are having in any area. I was always led to believe that as a rough rule that 30mph over any limit was more than likely a short ban, so she's less than that. I'd imagine it's going to be some points, may get away with 3, and a fine. MLC, sonic etc. will obviously be able to give an indication of policies, although they aren't the ones that ultimately decide on the 'punishment.' And as we all know it all depends on the judge as well - some of them see speeding as the most heinous of crimes and will slap a penalty accordingly. Hopefully it'll just be the basic 3 points and small fine.

    my aunt was dont last year 1st motoring offence 64 in a 40 zone she went to court got 3 pts but a £200 fine and had to do her driving test again.

    53 mph in a 30 mph
    I would doubt the CPS / PF, would consider this for a Fixed Penalty Notice, but it does happen

    As a first offence, with no previous convictions on the current licence
    If pleading guilty from the outset, expect 4 points a fine of between £150 and £200
    If pleading guilty expect 5 points a fine equivalent to one weeks wage or at least £200 (whichever is the higher)

    Disqualification is also an option, but is very unlikely for a first speeding offence
    If disqualification is considered then there would be no points and a fine only

    That sounds like a disqualification
    A court is no longer permitted to apply both points AND a disqualification, when a retest is required
    That would be grounds for an appeal

    My first ever offence was 101 on a motorway, I got a summons due to the excess speed, got a 2 week ban, a £300 fine but no points.

    The duty solicitor told me I would get that before we even walked in the courtroom as that was what Telford & Wrekin (Local Authority) were handing out at that point in time.
