    Default Good news, bad news and some advice needed

    Hi everyone,

    My boat crew passed his test first time on wednesday. That's the good news. The bad news is that he was in Sainsbury's car park on friday and offered to move one of his friend's cars. Guess what, the BIB were there and he is now being done for driving without insurance.

    He thought that a car park was not the highway and he was able to move the car. Apparently not. He has insurance for 2 other cars (a very old classic mini and a fiesta) but not entitled to drive other cars on the policy.

    Any advice on whether this is worth defending and seek a sympathetic magistrate nor just swallow the 6 points and have to re-do his test would be gratefully received.

    What really tee's me off is that in pre-target days, the BIB would have simply just given him a rollocking and let him on his way, but we must get our quota of arrests, mustn't we.

    Probably lucky that his mate was not done for aiding and abetting (if he gave consent) or Jake was not done for TWOC'ing (if he didn't give consent) - 2 more potential arrests to the monthly target missed, there.

    I would have thought so too, however I suppose it would depend on statutory laws as although its private land yet allows public access?

    why did the bib approach him in the first place they wouldnt know if that was his own car or not, was he doing something to draw the attention of the bib,
    i do aggree that a ticking off wolud have been sufficient in this case as presumably no damage or harm was caused, i was told that it is at the disscretion of the officer if any charges should be made.

    Bunch of lads with cars I suppose - he assures me that they weren't doing anything wrong.

    He's the guy at the sharp end of the boat in the picture on the right, by the way

    this is what i dont understand about the law a couple of years back my son got knocked over by a young driver who was driving a car that had no valid mot on it (ony out by 5 days but still out) no charges was brought against him because he took his car to a garage for an mot a few days later where it passed, i kicked off when i was told that no charges were going to be made against him as they dont prosecute everybody, my son was lying in hospital with a broken ankle and fractured skull.

    In law a private car park that allows access to the public WILL require the car and driver to have insurance. It comes under the "Road Traffic Act" The same is true of municipal car parks.

    It may well be within the letter of the law, but it seems somewhat petty to me. It's not as if the person who moved the car was intending to drive it on a public highway. I assume the same would apply if someone was to move another family member's car (which was blocking his/her own car in) off a driveway (with the owner's permission) onto the road outside the house to enable him/her to drive his/her car off the driveway.

    Meanwhile, real criminals are busy at work.

    Unbelievable bad luck mate.

    Agree there John, the law in some cases is a complete ar$e. This is an example of him being extremely unkucky
