    Default question for police

    friend got stopped doing 57 in a 30 zone on his fireblade, police then decided that his reg plate wasnt legal, so removed it and gave him a business type card to carry incase he was stopped later on, but the problem lies with the "statement" the p.c. took in his notebook.
    friend states that the policeman had incorrectly identified the street which the offence took place on, and also after reading the statement back, did not ask him to sign it, all this took place under scottish law, but he wonders if he has got grounds to plead not guilty
    any help would be most appreciated

    Sorry, but it annoys me when people try and get out of these things.
    Would he plead not guity if he's crashed into a pedestrian with a pram at 57mph??

    Don't spead in 30 zones! thats why they're there. Fair enough a little over, but not double!!

    Yep he did it, got caught so should pay the penalty. 57 in a 30 is taking the pish! 35 in a 30 might be different but that just plain stupid.

    A few MPH over the limit is one thing, but 27mph over in a 30 zone is taking the P*ss a little dont you think.

    I do understand him trying to look for a way out of it though, i would be doing the same in his shoes through fear of getting banned, but the bare facts are, He is Guilty!

    Years ago(1998)a freind got nicked for no insurance in an Escort, the Police got the registration number wrong on the paperwork, the reg was C693 DUB, and they put something like C693 EUB, but the details of the car were right, EG: Colour, Model etc.It went to court as it was his second no insurance and he was facing a ban, and basically the judge told him to F*ck off, he was guilty and that was that, there were enough correct details to prove that he was the driver of the car at that time.

    I'm afraid I can't give you any advice.... the law is completely different for evidence and burden of proof, so I don;t know the right procedure for a roadside interview north of the border.

    Tell your mate he is a dangerous tW4t and that he should take whatever he gets with good grace..... if he contests it, and it is proven he is guilty, it'll only make any sentence worse.

    The officer may not have put the road that he was stoppped on, but the road he put is probably still a road that your mate drove down.

    Tell your mate, to take the punishment and STOP trying to wriggle out of it.

    If you can't do the time, don't do the crime.

    It really, fishes me off this does. The same people then complain if some one else gets away with something else on a tchnicallity.


    I've been caught speeding twice in my life, and paid up and took the points on the chin. That was a long time ago too.

    message to admin, please close this thread, i was merely asking for advice, not a complete lambastment of said persons character, whether he is guilty or not is not the point, but whether the police officer handled the situation correctly.
    i was asking for a policemans thoughts on the situation, nothing more

    As Jamie has said, the name of the road that he was stopped on might not necessarily be the road on which he was seen doing the excess speed.
    Either way as has also been said it doesnt really matter, an admin error is just that..an admin error. it doesnt mean that something is null and void because of it.
    Having just come back from dealing with yet another family of someone who killed themselv doing exactly what your mate has done, my sympathy level isnt very high.
    Your mate just needs to pay attention to those little signs then he wouldnt have to worry about 'getting off' of it.
    Sorry emotions running bit high at the mo!!

    no worries mate, personally, i also think he is atw4t, even more so by the fact that he only passed his direct access a couple of months ago.
    i dont think he even realises the power of that bike, like a lot of replies have stated he needs to stand back and take a good look at himself.
    his main fear i think is that he is a bus driver, he actually says he will be happy if he gets a huge fine, but only about 3 points
    he dont have a leg to stand on in my opinion, but i still cant understand why the officer removed the reg-plate

    His best bet then is to go to court put his hands up, beg and plead with the court re loss of licence loss of job, financial hardship, what a plank he's been, learnt a lot etc etc. Might even do him good to apply for an IAM advanced course, all good stuff to tell the court and might actually help him keep his licence.
    Dont know why they took his plate though...must be a Scottish thing!
