    Default FAO: Any police officer out there

    We have a van at work that has been declared SORN for the last few months as it has been having
    some work done on it. This is a spare van that is only used when other vans are off the road and is not
    in the best condition but it has just gone through its mot and is now ready for the road again.

    It has just been given to one of our branches to use whilst their van is off the road but it isn't displaying
    a tax disc, and when the issue was brought up with our head office, the reply was 'the tax is applied for, it's perfectly legal to drive'.
    When the driver said that he didn't want to drive it as he didn't think it was legal, he was told...'if you
    don't want to drive it, go home and you'll face disciplinary action' So the company are in effect forcing the guy
    to drive what is in my eyes, an illegal vehicle.

    I know it's not legal to drive it when it's untaxed, but as the tax disc will go via our head office when it arrives,
    and there will be a couple of days delay in it actually being displayed in the van, is it still illegal to drive it, not
    displaying a tax disc even though one has been issued for the vehicle.

    As far as i am aware, any vehicle not displaying a valid tax disk is breaking the law unless it is declared SORN or being driven to or from a garage for an MOT.

    I'm sure there are two seperate offences, not having a valid tax disc and not displaying a valid tax disc, as far as I know.

    It is an offence to fail to display a tax disc (even if it's got one).

    The driver would be commiting an offence, as would the manager making him drive it.

    i had this problem a few years ago with a company van and also refused to drive it until the disk was in the window, my gaffer at the time said it would be ok but i was adamant i was not going to use it, as far as i am aware the driver of the vehicle is liable for the vehicle so if any defects ie:- worn tyres - not taxed - lights out etc, then it is that person who is prosecuted....

    tell your mate to say no chance and if you have a union report it straight away...

    I think he's just frightened of the disciplinary action by the company, but i don't think they would have a leg to stand on if it came to this.

    i was the same mate but it has to be done....tell him you have been in touch with the forum and the guys on here it may ease his mind some what,
    they are breaking the law telling him to use it

    Out of interest, is no tax an endorsable offence or does it just carry a fine?

    No just a fixed penalty of £80 and seizure of the vehicle which a fee would have to be paid to recover the vehicle, we have an operation going on at the moment called 'Operation Debar' !

    The driver and the manager and even the company could get done,under what we call 'Use,Cause and Permitt', so i would'nt drive it !!
