the link to the LV website clearly states if you drive without a valid MOT, your insurance MAY BE invalid.
I'd have thought if it was as cut-and-dried as you suggest, it would be worded WILL BE invalid.
it depends on the circumstances.
subsequently, the cops WON'T take it and crush it.
vis-a-vis, scaremongering.
also, you ARE allowed to drive away from the MOT station, with a fail sheet in hand, to a place, where, BY PRIOR APPOINTMENT, repairs will take place to rectify any faults.
because........SIGNUM!
And what if you are taking it home because you can rectify them yourself? As most of us do anyway... no appointment or whatever it means do not drive it as it avoids your insurance .. granted the copper must have a bad day to take the car even if it is all above board but it is his decision at that point not yours.
They'll probably even chuck in a reason for them to pull you over and to make a long story short... it means bye bye car. It isn't scaremongering it is a reality.
but it isn't, is it?
a reality, that is.
you're just banging on about fictional scenario's, we all know you're not going to lose your car driving it home from an MOT station, any more that driving it TO the MOT station.
let's take YOUR scenario to it's extreme.
an officer of the law pulls you over for having a defective tail-light.
that fact makes it an MOT failure.
therefore your insurance is invalid.
therefore, your car is forfeit.
has that EVER happened?
no, of course it hasn't, because you're being ****ing ridiculous.
because........SIGNUM!
It's not a fictional situation if it has failed for being dangerous.
When the law changed in May last year, it went to 2 categories of failure, as I'm sure you are aware.
So, if it failed on a major fault, as you say, drive it home, to another garage or whatever you see fit to have it repaired, it is major, but not dangerous to drive as such
Then you have a 'dangerous' category.
"Dangerous - A direct and immediate risk to road safety or has a serious impact on the environment.
Do not drive the vehicle until it’s been repaired."
It is kinda in black and white and to be honest, if anyone is stupid enough to think it is ok to drive a car that a government appointed tester has deemed dangerous, you deserve to have your vehicle taken away from you.
Not just looking at it from the point that it's illegal, but also that if you had an accident, or heaven forbid, seriously injured someone, or worse, it just isn't worth the risk. Especially for the sake of having the place that tested it, repair the vehicle (if that's a service they provide) or spending a relatively small amount on having it moved, professionally, to a place you want the work done.
I get a lot of us do a lot of our own work on our vehicles, from the point of if you don't ask, you don't get, ask the garage if you are able to borrow some tools or something, obviously, depending on what work is required or what the failure is

I understand what the law says.
I understand (and agree) with what you say SHOULD happen.
my argument is with what Mr Pole says WILL happen, carte blanche, every time.
we all know it won't, and doesn't.
because........SIGNUM!
I think why what should happen doesn't happen is a whole new can of worms!
