    Default car park crash

    Was in sainsburys carpark earlier I was drivin across the car park and this woman came out of no where so I slamed on and we collided and we've damaged both cars.... who is at fault ?... also is it worth goin throught insurances or not would it come out as 50/50 are we wastin our time ringing them as my bumper can be repaired her has has smashed her headlight bumper and wing can anyone shine a light on this please

    You need to expand on the story to make an assessment, where you both cutting across empty spaces etc, or you following the inner road ways and she driving over spaces, or which was over the white line when entering or exiting etc...

    Therefore unless one of the cars is not moving, the liability is 50:50

    If both parties can agree to resolve it do so, if not then process through your insurance but expect it to be processed as an at-fault claim

    Car parks are private property. Depends where the damage is. I was once travelling up the aisle and a woman pulled out of the space and hit my rear arch. She admitted liability but next day barked that she had a wutness saying i was speeding. (no speed limit as it is private land)... Long and short she turned out be be at fault due to her hitting my rear. Had she hit the front then would have been 50/50

    I would say insurance would go 50/50 as yo them its the cheapest solution

    Private property so highway laws do not apply. I had my car hit someone gave me the registration reported it to the police who said it was not a public highway and insurance company said I was not covered for private property. DVLA would not give me any details as the data protection act does not allow it. I ended up paying for it out of my own pocket.

    I'd just walk away from it insurance will make it a nightmare to claim and if it can be fixed for couple hundred quid do that prob be cheaper in the long run

    look at what excess you have and also look at what the premium will jump to next time, even if it isn't 50/50 I can bet that by the time the other party writes the form out it will look like like a 50/50 or worse, had it myself many years ago you wouldn't believe the stories people make up to get out of it, only real way now is to fit a camera that can record front and back at the same time and submit that as evidence, lorries,buses and coaches use them now as it got beyond a joke with people overtaking them and then anchoring on to get a whippy out of it.

    I know of quite a few who have claimed for car park dings from peole driving into them so YES you can claim.

    But by the sounds of it it will go 50/50
