    Default sale of goods act?...

    Just wondering if anyone can advise what i am entitled :

    We purchased a morphy richards kettle from comet last april. Beginning of this month we noticed it leaking round the base and at the level indicator.
    Comet are no longer trading so we sent photographs, copy of invoice and kettle details to morphy richards.
    Due to the delay of this procedure we purchased another kettle as it is a daily used item.
    Morphy richards have offered a similar replacement as the kettle is no longer sold.
    We require a refund but morphy richards wont accept.

    Kettle is less than 1 year old and well within the 2 year cover offered by morphy richards.

    Most they will offer is the cost of the kettle against any of their products.

    We require a refund only as we dont reqire any goods. Can we demand this?

    Simple answer is no, they are offering you a like for like replacement. If comet were still trading you would probably have had the option of a refund or replacement but the manafacturer doesn't have to give you that option.

    I believe they are only required to offer a like for like replacement as has been said - the retailer may offer other options (if they're still trading).

    Simple answer... take the replacement and flog it.

    id accept the kettle and stash it in a cupboard somewhere as your probably need another on in a few years lol

    Your contract is with the vendor - Comet not Morphy Richards. Unfortuntely Comet have folded s o I think it's one of these things. Infact, is the manfucturer even liable to offer a replacement?

    Yes Gaz,

    If the vendor is out of business, it's down to the manufacturer...

    By offering a replacement they're within their legal rights.

    Bit of a pain really, but all perfectly legal
