I always thought that if the council were aware of the pothole they were then liable from that point onwards?? That said, I'm sure you would have a very hard job to prove they knew about it before your accident.
There's a stretch of duel carriage way near me with deep ones the full stretch, you have to sit in overtaking lane to avoid, bed. Like this for 6 months... Reckon if they where oaying out they would be fixed quicker...
A mate of mine who's a copper has started a claim against the council.
He hit a pothole and it broke a spring.
He was convinced it had done more damage so claimed on his insurance.
He said if the hole has spray paint around it you are stuffed but if it hasn't you can claim.
He even took pics with a tape measure next to the hole!
His insurance company are sorting it out.

i put in a claim in Jan 2011,havent heard back from my solicitor since Aug 2012,as said,your flogging a dead horse.
End of day if it was easy simple and fast to claim, nobody would have weld repaired snowflakes as you just put in a claim willy nilly and get a new one. For all they know you could have done it mounting a kerb or wheel cracked before you even bought car and just trying it on like many people do. I hate potholes but you really are peeing in wind trying to claim a new wheel. Save your self hours of letter writing and solicitor fees an dont bother
Anyone got or know of anyone that has a 11 spoke 18" wheel? i really cant be arsed with the council route if I can get a cheap enough wheel
potholes are a pain mate.cracked 2 wheels in 6 months and i think i might have another as well now.gonna check it at some point as the tyre goes down a lot.
