    The fault of the silly man driving, obviously... or are you willing to risk saying the young lady's assessment is wrong ?

    But going by the flat 'letter of the law' the other driver (almost) pulled out into the path of other traffic - his fault.

    Going by the attending traffic officer, given the learner vehicle ahead, it could reasonably have been assumed the other driver was likely to pull out and so your actions to attempt to overtake at that point show a lack of consideration for the situation, also termed 'Driving without due care'... moreso given your proximity to the other vehicle on a damp tarmac surface, you could easily be considered to be far too close to safely brake if necessary.

    At best - 50:50..... at worst - DCA You... would you take a seat in the back of the Police vehicle, sir... and bring your licence...

    This is all to common IMO, My first point is that by being on the outside lane and accelerating does not break any laws. Secondly why assume what speeds were reached further down the road when the speed limit is 70mph. My third point is slower moving traffic should always make sure that it is safe to maneuver before doing so. My car can accelerate to 62mph in 7.2 seconds safely without breaking any laws.(This was ascertained via GPS). Blinkered owners of slower less powerful cars should not assume that the coast is clear just because it was 3 seconds ago. The Balloon in the slower lane should have held off until he/she check it was safe to pull out, end of........100% in the wrong was the slow lane driver. IMHO

    PS It was more start maneuver then signal on his behalf, freaking idiot

    the numpty in the renault for not paying attention , so what if the OP was accelerating quite hard , wasn't as if he was over the speed limit .
    no point having a car with a bit of poke if you can't use it .

    the book says my DTI takes 10 secs to 62mph but that was when it was fresh. 10 years and 110k miles might have made it take a bit longer.

    at any rate both cars were no where near up to speed. Like I said I was quicker than the megane but its not like I'm driving a VXR!

    From an insurance point of view, it would go 50/50. However, the nutcase should have checked, then indicated, then pulled out. Rather than indicating and pulling out at the same time.

    see it a lot lately , the numpties either don't indicate at all , indicate once half way out or indicate then pull out regardless , i am getting better at predicting what someone may well do ,lol

    I don't see how this can be deemed 50/50 by anyone. The plank is moving into another car, how can driving into someone be 50/50.

    Sadly, most insurers can't be bothered with the time and expense of a full and proper investigation and then the subsequent delays when the other party disagrees with their findings, unless it's blatantly one driver at fault and no argument. So in this case the insurers would say the Renault drivers pulled out when he shouldn't, but also the OP was too close to be able to stop... so quick and easy solution: 50:50 blame.... and raise both parties premiums next renewal.
