    Default where do i stand regarding damaged item by courier

    I bought some wind deflectors off eBay, the person who I bought them from is a member on here. They were in perfect condition when posted to me and were well wrapped in layers of bags, black bags and celetaped all round. I have received them from the courier and the front ones are snapped so I put in a claim against the courier and this is the email I received. Just wondering were I stand regarding Dear Jonathan,

    Unfortunately I am unable to process the claim due to the following:

    We advise that all items must be boxed to be suitable for transit. Any unboxed item is deemed more vulnerable to damage, and classed as a prohibited item. Please see our terms of use:
    ** Your Consignment/s must be packed to a reasonable standard, packed within a double walled cardboard box with the contents cushioned and protected inside.* The packaging must also be sufficient to protect the Consignment's weight.* It is not always obvious when a Consignment has not been packaged properly. The Carriers will assume that Consignments have been correctly packaged and will exercise a level of skill and care appropriate to that. Any claim resulting from a parcel that is not packaged to a reasonable standard and in line with the above may be declined.

    I was always under tbe impression, Its upto the seller to claim compensation? The seller entered into contract with courier, not you. It it upto seller to package item to avoid damage and make sure they insure for damages.

    Imho you should refuse item and asked for refund, seller should then make a claim with courier.

    Have to admit, this was always my understanding too. It's also why numerous ebay sellers have big fut-covering statements on their listings to try and avoid having to put in claims for items damaged by couriers.

    Sorry I didn't explain it properly, I arranged the courier as it was collection only

    Ebay rules are clear on damaged items, notify buyer, send pictures and return for refund

    Ah, I see. Fair enough then, it is indeed probably going to be you that needs to try and calim against the courier then.

    Kind of a difficult one to be fair. You seem to admit that the deflectors were reasonably packaged, so seems a bit unfair to lay any blame on the seller. I don't think you are trying to do that anyway.

    Other than instigating a claim against the courier, which you have already done, I'm not sure there is much more you will can do other than sit and wait. Not sure I'd hold my breath. Ideally you would have checked the parcel was undamaged before signing for it, however we all know that's not generally possible. It's usually a case of as quick as the delivery driver can chuck it at you and make a getaway!

    It was a lad on owners club so it weren't his fault and Mrs signed for it. The courier have said that they won't pay for it as it wasn't boxed but there a bit awkward to box. So I've sent an email back to them

    This changes everything Not much you can do if parcel wasn't packaged to couriers requirements.
