Default Grrrrr damn pot holes in the road

    now im so pi**ed off

driving down the road by the house and suddenly thud, got out
and had a look at me alloy and ive now got a chunk out of the
rim edge of me snowflake alloy on passenger side front.

ive had these alloys on since i bought them brand new 13mths
ago and they dont have any scuffs or kerbing marks, there as
brand new as wen i first bought them but now 1 alloy has
    a chunk out of it.

been onto the council and reported the claim so lets hope they
pay out for a new one.

Do you have legal cover on your insurance policy? if so call the insurance company and advise them of the issue, the council will almost certainly send you a f**k you letter but tend to take more notice when dealing with a legal body.

think it all just depends on the council, last year i hit one on a blind bend by the time i seen it i couldnt avoid it as there was oncoming traffic it was 6inches deep over a metre long and about 700mm wide it blew my tyre wrote the alloy off completely bent the wish bone the lot (was a 60mph b road) this was at 4pm i took pictures got home sent them straight to derbyshire council along with a map pinpointing location on the bend and how potentially dangerous it was and within 2 hours workmen were out and the road was repaired, then i made the claim and after a 3 month battle with them going down every possible route but court, they refused the claim and the appeal

Its about time VED was ring fenced again, and the money used where it was supposed to go, the upkeep of the roads and not to keep junkies and scroungers in a life of luxury. Good luck with the claim.

My understanding is the council will only pay out if they were made aware of the pothole and it wasn't repaired in a timely manner. If they aren't informed of problems, they really can take the "well we didnt know" approach, and it works for 'em in 99% of cases.

The only possibility of claiming, if it hasnt been reported before, is to get a copy of their maintenance reports for that particular road. Councils have to "maintain" roads (supposedly...) but carrying out periodic inspections. If they have not checked the road in compliance with the "code of practice" for maintining highways, then you have something, although going that route is long, and possibly need to get as far as "the last thing you can do before court" before they even think about paying up.

Had similar myself on the back road through "The Humbers". Front tyre started going down, took it to be checked, whopping great dent in inside rim of alloy. Didn't think to take picsa of tyre/wheel, probably wouldn't have been able to find the pothole again.
The councilsd should be resposible for every one of these that occur, but invariably try to weasel out of any responsibilty.
