    Default is this right making a claim against someone

    im with chris knott have 4 yr protected no claims fully comp with all mods declaired never had a claim in my life.
    yesterday the wife was coming out of a supermarket carpark.

    a woman cut the corner stopped on the junction on a public crossing and waited. the wife couldnt get passed so she put the window down and told her to move as she cannot get pass. the woman moved and scrapped the front bumper and side wing no dents just paint came off.
    so the wife got out and went over to her the woman who was polish would not give her any details and only bit of english she could say was not my fault she just repeated it over and over.

    so we went to police with her reg they basically told us to phone insurance company up as they could not give us any details because of data protection.

    we just phoned insurance up they have said they will send us to one of their garages for the work to be repaired we have to pay the excess then the insurance will try and claim off the other party.and only when they get the money back off the other party will we get our £400 excess back.

    last night a friend who does insurance repairs told me i just go and get 2 qoutes for repairs and submit them to the insurance company.

    and their was nothing about paying for my excess upfront for something that wasnt our fault.

    which is right seems stupid i pay for damages for them to try and get a payout off the person who crashed in to us.

    If you have legal protection you can get them to try to make a claim via her insurance first. I did it this way a few years ago.

    i think we have legal cover will check.
    the insurance did at first give me the womans insurance phone number and told me to contact them direct to make a claim.
    but i said to my insurance xcompany isnt that what i pay you to do thats when she said yes but you have to pay for your excess first then hopfully claim it back off the woman who hit our car. confussed isnt the word

    Save paying excess is by phoning her insurance company in hope they'll pay for repairs to your car thus saving her insurers money. If ur insurers contact her insurer. The money rises to £400 excess plus repairs cost. If u contact her insurers, they pay only repairs. Saving you excess and NCP! And her insurers charge her more premium.

    Win win really.

    Makes sense?

    How bad is the damage? Might have been easier and cheaper to pay for the repair yourself, because if she doesn't admit liability you could be out £400 and loose your NCD.

    Your insurance should tell you who she is insured with.
