    Default Redundancy - contracts ect

    Hi all

    I'm sure one of you will be able to answer my question or help
    I am a contractor who I have worked for our client for just over 4 years now lately our contract renewal has on been on a 6 month basis where as before it's normally been "right lads we are safe for 2 Years ect"

    I recon we have lost the contract BUT this is where I need your advice , as we are a contractor on this site we have the Option IF we loose the contract to stop with our excisting company and move on or see what the new company has to offer and "jump over" and work for the new company

    Question is if we move over and leave our old job would there be any pay off ect I don't think there is but hey ho you never know

    I dont think there would be any pay off. Its one of the main reasons companies use contractors. When the contract comes to an end its either renew or goodbye. If they decided they didnt need you mid contract, then thats a different kettle of fish altogether.

    As off oct 2011 any contractor who works over a 12 week period is entitled to the same rights as a full time employee. Holiday pay and redundancy etc... Which is why me and all the other contractors at my last place were laid off on Christmas Eve last year. 1 more day and we would have been over the 12 weeks.

    Generally if the the contract has a get out clause for the contractor then the employer also has the same terms, as such you would really both choose to walk away on equally level financial terms.

    If you leave your old job you are resigning so not eligible for any payoff.
