Mine went through the MOT last week and passed with flying colours as well, didn't comment on them at all but they did test to see if the washer jets worked
mine passed no comment made about hids and iv no headlight washers
She has no headlight washers either.
Its in the MOT but most testers dont pick up on it.
no probs with mot for me bloke said as long as there not out of liner there isnt a problem
My aftermarket HIDs went straight through the MOT in June.
As said,
as long as they're set correctly and not the wrong colour then they shouldn't fail (until the regs are established anyway)
All the regs require is that IF headlight washers and self leveling are fitted that they work, it's not a requirement to have them if you have HIDs as there are some cars that came fitted from the factory with HIDs but not the washers or self levelers.
It is however possibly a contravention of the Road Vehicles Lighting Act - which is one of the laws that governs the use of cars on the road. The MOT is not a test of whether a vehicle complies with all the Road Vehicles Acts. Otherwise it'd take a day or more to do the test. There are lots of things that you can pass an MOT with but have your car impounded by the Police once it's on a public road.
Aftermarket HIDs remain a grey area, but unless you have them badly set up or someone cites them as being a factor in an accident, they're unlikely to be an issue.
You can read the full MOT test manual on the Deparment for Transport website. It's very clear and easy to see what constitutes a fail.
