It can't be considered as an undertake, if there is a queue

Our queue was doing North of 70mph at the time he accelerated to over 80mph to pass me and two others before having to cut up a BMW to get into lane 2 to avoid slamming in to a car in the inside lane doing about 60/65mph.

It doesn't matter what the speed is, it is still a queue if there are at least three vehicles in front within 4 seconds of each other
The more serious offence would be speeding, as the Motorway between M8 and M77 is either 50mph or 60mph
It is very rare to get a queue of traffic beyond the 70mph signs, all at 70mph
Usually by early evening it is down to 50mph due to the volume of traffic; I've only been in it once southbound, much prefer it northbound at that time

My description seems to be at fault more I think,

The outside lane were all bunched up but doing the limit from the Maidenhill junction south at about 70mph, there had been some trucks causing the pouter lane to be really busy it was early rush hour and flow was OK not great. I say queue as we were all line astern as far as the eye can see so to speak.

I had increased my gap considerably over normal driving as this Vectra was that close to me, over many miles consistently and weaving in and out. I left perhaps 20 yards gap instead of say 15.

It annoys only in so much that when you are travelling as fast as the conditions allow and there is nowhere to go as the lane 2 is still faster than lane 1 people want to overtake.

We are all in a hurry, we all have places to go if he did that in Asda he would get battered!!!!!

It is still a queue, undertaking cannot be an offence (any more)
When this amendment was made to Careless Driving, it did not take into account the traffic flow speed or the differential, only the amount of traffic

Undertaking remains an offence, but this is where there is a gap greater than 12 seconds between vehicles
