    Default Work related advice required

    Where I work we get 1 lieu day for every 5 days worked away from home. The idea is when you get back you take them to "recover" from your work away but as to when you get to take them is at the companies discretion.

    Last year I pretty much worked away 5 months solid and collected quite a few lieu days

    We have been taken over by a new company who has told meI will sell 20 of my days and all lieu days will be taken at the end of the year or be lost.

    At present I am still on my old contract from the original company and I have now refused to sell my days back at the flat rate of 8 hours pay per day.

    They money is not the issue I want the time off but the new company will not allow this as it is a "debt" they do not owe so want the original company to pay us off.

    My contract says nothing about having to sell back lieu days or that they expire.

    Am I doing the right thing standing my ground and refusing to sell my days?

    There is something called TUPE, that you may wish to look into. Although I would have said as you are now working for a new company, then they can pretty much change your contract, although you should really need to agree to the changes.

    Dare I ask if you are a member of a Union? They would be able to advise you better?

    Thats the point there has been no discussion with me just an email saying you will sell 20 days or lose them. My contract has not changed (or if it has I have not signed anything)

    Looking at the TUPE it appears unless the contracts have changed they have to honor anything until at which point they do issue new contracts.

    They keep saying the contracts will not change yet our health care is changing, our pensions are changing our daily rates. Seems weird for a company that "will not be changing anything"

    Indeed, I was shafted in my old employment, new franchise took over where i worked, and gave us the required notice of contract variations, with a accept or hard luck attitude. 5 of the team of 9 I was on found new employment within 6 months.

    Take the cash whilst the offer is still there, Lieu days traditionally are good for 12 months from first date of acrewment.

    Depends what your contract says!

    I made a deal sold some on the agreement that I get 3 weeks off this year when I want them which won't be taken as hol and seems to be ok

    Companies seem real quick to abide to TUPE what a waste of time that is!
