    Default Suing the council???

    has anyone or anyone you now, ever been successful in suing their local council becasue their potholes have damaged a whee and wrecked a tyre?

    ive just hit a hole in the road coming home from work and my snowflake has cracked and my tyre is goosed.

    i wasnt going hard at all, but the pot hole was unavoidable.

    the tyres are only on my car in september its totally gubbed.

    its gonna cost me a tyre, alloy repair and god knows what else its done to my car.

    not sure, i here of some people winning, and some not winning. Though, if you are going to argue it, You want as much evidence as possible. So pcitures, pictures and even more pictures.

    ive been back out there with the camera and took pics............also took a ruler so i could put it in and took pics of the depth...and lucky enough, the crater has the councils yellow marking paint around it, so i reckon i have a case

    We have battled our council and lost - they provided supposed "proof of regular inspections" - However, if the pot hole has been marked for repair, they do have guidelines on how fast they should fix it or effect a temporary repair - so I guess it depends on when they marked it and if anyone reported it before........

    Have you talked to the council rather than jumping straight into suing them?

    A judge will want to see you've tried to resolve it directly before brining it to the court.

    not spoken to them yet...........only happened about 2 hours ago.

    im going into road department tomorrow ( they're next door to me, i work in social work ) so they canny escape me lol

    I think bigboynigs did, for a smashed alloy because of the potholes, and he was successful, maybe drop him a PM

    I think you need to get a quote of repair from 3 repairers aswell to present to them. But see what they say beforehand. I tried a couple of years ago and because it had been inspected within the last 6 months then they weren't responsible because they hadn't "neglected" the road

    Same happened last year buckled the alloy and damaged the steering and they never wanted to know as it wasn't reported before hand

    You need a hummer to get around the roads here
